66 relating to climate change planning and reporting.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle C, Title 5, Health and Safety Code, is
99 amended by adding Chapter 396 to read as follows:
1010 CHAPTER 396. CLIMATE CHANGE PLANNING AND REPORTING
1111 Sec. 396.0001. DEFINITIONS. In this chapter:
1212 (1) "Commission" means the Texas Commission on
1313 Environmental Quality.
1414 (2) "Office" means the office of the state
1515 climatologist.
1616 Sec. 396.0002. CLIMATE CHANGE IMPACT REPORT. (a) Not later
1717 than June 1, 2024, and before the end of each successive four-year
1818 period after that date, the commission and the office shall prepare
1919 a report on the potential impact of climate change in this state.
2020 (b) The report required by this section must include
2121 information regarding:
2222 (1) scientific predictions regarding changes in
2323 temperature and precipitation patterns and amounts in this state
2424 that could result from climate change;
2525 (2) the potential impact of climate change on:
2626 (A) human health;
2727 (B) the economy and the management of economic
2828 risk;
2929 (C) infrastructure;
3030 (D) surface water and groundwater;
3131 (E) emergency preparedness;
3232 (F) state and local government finances;
3333 (G) forests, wildlife, and fisheries;
3434 (H) agriculture; and
3535 (I) recreation and tourism;
3636 (3) significant uncertainties about climate change;
3737 and
3838 (4) economic opportunities created by the potential
3939 need for:
4040 (A) alternative sources of energy;
4141 (B) climate-related technologies, services, and
4242 strategies;
4343 (C) carbon sequestration technologies; and
4444 (D) technologies for the capture and utilization
4545 of fugitive greenhouse gas emissions or other mitigation
4646 strategies.
4747 (c) In preparing the report required by this section, the
4848 commission and the office may consult with other state or federal
4949 agencies or academic institutions, as appropriate. The report
5050 shall reflect any diversity of views within the scientific
5151 community and among the entities consulted by the commission and
5252 the office.
5353 (d) The commission and the office shall make the report
5454 required by this section available to the public in print and on the
5555 commission's Internet website.
5656 Sec. 396.0003. GREENHOUSE GAS INVENTORY. (a) The
5757 commission and the office shall annually compile an inventory of
5858 greenhouse gases emitted in this state by all sources.
5959 (b) The inventory required by this section must establish:
6060 (1) a baseline of greenhouse gas emissions to be used
6161 to project future greenhouse gas emissions in the absence of
6262 governmental intervention;
6363 (2) greenhouse gas emission trends; and
6464 (3) the relative contributions of major sectors,
6565 including the transportation, electricity generation, industrial,
6666 commercial, mineral and natural resources, alternative fuel,
6767 agricultural, and domestic sectors.
6868 Sec. 396.0004. CLIMATE CHANGE ACTION PLAN. (a) Not later
6969 than December 1, 2024, and before the end of each successive
7070 four-year period after that date, the commission and the office
7171 shall create a climate change action plan.
7272 (b) The climate change action plan required by this section
7373 shall:
7474 (1) include the information gathered as part of the
7575 greenhouse gas inventory described by Section 396.0003;
7676 (2) evaluate cost-effective strategies for reducing
7777 or offsetting greenhouse gas emissions, including the costs,
7878 benefits, and co-benefits of those strategies, and how those
7979 strategies impact the capability of meeting future energy demands;
8080 (3) identify areas of disagreement regarding
8181 strategies covered by the plan; and
8282 (4) recommend legislative changes necessary to
8383 implement the plan.
8484 (c) The commission and the office shall deliver the climate
8585 action plan required by this section to the relevant standing
8686 committees of the senate and the house of representatives and make
8787 the plan available to the public in print and on the commission's
8888 Internet website.
8989 SECTION 2. This Act takes effect September 1, 2023.
