| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 342.003(c), Local Government Code, is |

| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) Subsection (a)(8) does not authorize a municipality to |
|---|
| 13 | 13 | | confiscate fireworks in the possession of a person if the person |
|---|
| 14 | 14 | | possesses only packaged, unopened fireworks. |
|---|
| 15 | 15 | | SECTION 2. Section 342.013(a), Local Government Code, is |
|---|
| 16 | 16 | | amended to read as follows: |
|---|
| 17 | 17 | | (a) A home-rule municipality that regulates fireworks may |
|---|
| 18 | 18 | | not confiscate fireworks in the possession of a person if the person |
|---|
| 19 | 19 | | possesses only packaged, unopened fireworks. |
|---|
| 20 | 20 | | SECTION 3. This Act takes effect September 1, 2023. |
