55 AN ACT
66 relating to the cessation of tolls on segments of State Highway 99
77 located in certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 228, Transportation Code,
1010 is amended by adding Section 228.060 to read as follows:
1111 Sec. 228.060. CESSATION OF TOLLS ON STATE HIGHWAY 99 IN
1212 CERTAIN COUNTIES. The department may not charge a toll, either
1313 directly or indirectly through an agreement with another entity, on
1414 a segment of State Highway 99 located in a county with a population
1515 of less than 75,000 if:
1616 (1) the county submits to the department a resolution
1717 adopted by the county stating that the imposition of tolls on the
1818 segment has created a safety hazard on another state highway
1919 located in the county; and
2020 (2) construction on or a closure of a highway or other
2121 public road is located within two miles of the segment.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2023.
