| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 228, Transportation Code, |
|---|
| 10 | 10 | | is amended by adding Section 228.060 to read as follows: |
|---|
| 11 | 11 | | Sec. 228.060. CESSATION OF TOLLS ON STATE HIGHWAY 99 IN |
|---|
| 12 | 12 | | CERTAIN COUNTIES. The department may not charge a toll, either |
|---|
| 13 | 13 | | directly or indirectly through an agreement with another entity, on |
|---|
| 14 | 14 | | a segment of State Highway 99 located in a county with a population |
|---|
| 15 | 15 | | of less than 75,000 if: |
|---|
| 16 | 16 | | (1) the county submits to the department a resolution |
|---|
| 17 | 17 | | adopted by the county stating that the imposition of tolls on the |
|---|
| 18 | 18 | | segment has created a safety hazard on another state highway |
|---|
| 19 | 19 | | located in the county; and |
|---|
| 20 | 20 | | (2) construction on or a closure of a highway or other |
|---|
| 21 | 21 | | public road is located within two miles of the segment. |

| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
