88 AN ACT
99 relating to a study by the Texas Commission on Environmental
1010 Quality regarding the protection of certain water facilities from
1111 catastrophes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. (a) The Texas Commission on Environmental
1414 Quality shall conduct a study of potential methods for protecting
1515 public drinking water supply systems regulated by the commission
1616 under Chapter 341, Health and Safety Code, and wastewater treatment
1717 facilities regulated by the commission under Chapter 26, Water
1818 Code, from:
1919 (1) electrical outages;
2020 (2) catastrophic weather events;
2121 (3) conduct that constitutes an offense under Chapter
2222 424, Government Code;
2323 (4) the projected effects of climate change; and
2424 (5) other potential disruptions to providing water
2525 service.
2626 (b) The Texas Commission on Environmental Quality shall
2727 consult with other state agencies or interested persons as needed
2828 to facilitate the study.
2929 (c) Not later than September 1, 2024, the Texas Commission
3030 on Environmental Quality shall:
3131 (1) create a report on the results of the study that
3232 includes recommendations for legislative or other action to
3333 facilitate the protection of the facilities described by Subsection
3434 (a) of this section; and
3535 (2) submit the report to the governor and the
3636 legislature.
3737 SECTION 2. This Act takes effect September 1, 2023.
