55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of telehealth and telemedicine medical
88 services by certain health professionals located outside of this
99 state; requiring registration to engage in an occupation;
1010 authorizing fees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 1455.001(1-a) and (2), Insurance Code,
1313 are amended to read as follows:
1414 (1-a) "Health professional" means:
1515 (A) a physician;
1616 (B) an individual who is:
1717 (i) licensed or certified in this state or
1818 by a licensing agency in another state to perform health care
1919 services; and
2020 (ii) authorized to assist[:
2121 [(a)] a physician in providing
2222 telemedicine medical services that are delegated and supervised by
2323 the physician; [or
2424 [(b) a dentist in providing
2525 teledentistry dental services that are delegated and supervised by
2626 the dentist;]
2727 (C) an individual who is:
2828 (i) licensed or certified in this state to
2929 perform health care services; and
3030 (ii) authorized to assist a dentist in
3131 providing teledentistry dental services that are delegated and
3232 supervised by the dentist;
3333 (D) [(C)] a licensed or certified health
3434 professional acting within the scope of the license or
3535 certification who does not perform a telemedicine medical service
3636 or a teledentistry dental service; or
3737 (E) [(D)] a dentist.
3838 (2) "Physician" means a person licensed to practice
3939 medicine in this state under Subtitle B, Title 3, Occupations Code,
4040 or by a licensing agency in another state.
4141 SECTION 2. Sections 111.001(3) and (4), Occupations Code,
4242 are amended to read as follows:
4343 (3) "Telehealth service" means a health service, other
4444 than a telemedicine medical service or a teledentistry dental
4545 service, delivered by a health professional [licensed, certified,
4646 or otherwise entitled to practice in this state and] acting within
4747 the scope of the health professional's license, certification, or
4848 entitlement to a patient at a different physical location than the
4949 health professional using telecommunications or information
5050 technology.
5151 (4) "Telemedicine medical service" means a health care
5252 service delivered by a physician [licensed in this state], or a
5353 health professional acting under the delegation and supervision of
5454 a physician [licensed in this state], and acting within the scope of
5555 the physician's or health professional's license to a patient at a
5656 different physical location than the physician or health
5757 professional using telecommunications or information technology.
5858 SECTION 3. Chapter 111, Occupations Code, is amended by
5959 adding Section 111.010 to read as follows:
6060 Sec. 111.010. PROVISION OF TELEHEALTH OR TELEMEDICINE
6161 MEDICAL SERVICE BY HEALTH PROFESSIONAL LOCATED OUTSIDE OF STATE.
6262 (a) In this section:
6363 (1) "Commission" means the Texas Commission of
6464 Licensing and Regulation.
6565 (2) "Department" means the Texas Department of
6666 Licensing and Regulation.
6767 (b) Notwithstanding any other law requiring licensure or
6868 certification in this state, a health professional located outside
6969 of this state who does not hold a license or certification issued by
7070 an agency of this state may provide a telehealth or telemedicine
7171 medical service under this chapter if the health professional:
7272 (1) holds a current and unrestricted license or
7373 certification authorizing the health professional to provide the
7474 service and that is issued by a licensing agency of another state;
7575 (2) has not been and is not currently the subject of a
7676 disciplinary proceeding with respect to the license or
7777 certification described by Subdivision (1); and
7878 (3) registers with the applicable licensing agency of
7979 this state as provided by this section.
8080 (c) The agency of this state responsible for regulating the
8181 performance of a health care service in this state or the
8282 department, if no agency of this state is responsible for
8383 regulating the performance of the service in this state, shall:
8484 (1) register a health professional described by
8585 Subsection (a) to provide telehealth or telemedicine medical
8686 services to patients in this state if the health professional:
8787 (A) submits an application to the agency or
8888 department, as applicable, in the format required by agency or
8989 commission rule, as applicable; and
9090 (B) pays a registration fee established by rule
9191 by the agency or commission, as applicable; and
9292 (2) adopt rules necessary to implement this section.
9393 (d) A rule adopted under Subsection (c)(2) must provide that
9494 a health professional who provides a telehealth or telemedicine
9595 medical service under this section shall:
9696 (1) comply fully with all applicable laws of this
9797 state, including scope of practice, telehealth or telemedicine
9898 requirements, and standards of care;
9999 (2) maintain liability insurance in accordance with
100100 the laws of this state, as applicable;
101101 (3) consent to the jurisdiction of this state's courts
102102 for any litigation arising from the provision of a telehealth or
103103 telemedicine medical service under this section; and
104104 (4) be subject to investigation and disciplinary
105105 action for a violation of a rule adopted under Subsection (c)(2),
106106 including the referral of the violation to the licensing agency in
107107 the state that issued the license to the health professional.
108108 SECTION 4. Section 1455.001, Insurance Code, as amended by
109109 this Act, applies only to a health benefit plan delivered, issued
110110 for delivery, or renewed on or after January 1, 2024. A health
111111 benefit plan delivered, issued for delivery, or renewed before
112112 January 1, 2024, is governed by the law as it existed immediately
113113 before the effective date of this Act, and that law is continued in
114114 effect for that purpose.
115115 SECTION 5. This Act takes effect September 1, 2023.
