55 relating to the designation of fentanyl poisoning or fentanyl
66 toxicity for purposes of the death certificate and to the criminal
77 penalties for certain controlled substance offenses; increasing a
88 criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 193.005, Health and Safety Code, is
1111 amended by adding Subsection (e-1) to read as follows:
1212 (e-1) The medical certification on a death certificate must
1313 include either the term "Fentanyl Poisoning" or the term "Fentanyl
1414 Toxicity" if:
1515 (1) a toxicology examination reveals a controlled
1616 substance listed in Penalty Group 1-B present in the body of the
1717 decedent in an amount or concentration that is considered to be
1818 lethal by generally accepted scientific standards; and
1919 (2) the results of an autopsy performed on the
2020 decedent are consistent with an opioid overdose as the cause of
2121 death.
2222 SECTION 2. Section 481.102, Health and Safety Code, is
2323 amended to read as follows:
2424 Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists
2525 of:
2626 (1) the following opiates, including their isomers,
2727 esters, ethers, salts, and salts of isomers, esters, and ethers,
2828 unless specifically excepted, if the existence of these isomers,

236236 Criminal Justice for life or for a term of not more than 99 years or
237237 less than 10 years, and a fine not to exceed $100,000, if the amount
238238 of the controlled substance to which the offense applies is, by
239239 aggregate weight, including adulterants or dilutants, 200 grams or
240240 more but less than 400 grams.
241241 (f) An offense under Subsection (a) is a felony of the first
242242 degree punishable by imprisonment in the Texas Department of
243243 Criminal Justice for life or for a term of not more than 99 years or
244244 less than 15 years, and a fine not to exceed $250,000, if the amount
245245 of the controlled substance to which the offense applies is, by
246246 aggregate weight, including adulterants or dilutants, 400 grams or
247247 more.
248248 SECTION 5. Section 481.1121(b), Health and Safety Code, is
249249 amended to read as follows:
250250 (b) An offense under this section is:
251251 (1) a state jail felony if the number of abuse units of
252252 the controlled substance is fewer than 20;
253253 (2) a felony of the second degree if the number of
254254 abuse units of the controlled substance is 20 or more but fewer than
255255 80;
256256 (3) a felony of the first degree if the number of abuse
257257 units of the controlled substance is 80 or more but fewer than
258258 4,000; and
259259 (4) a felony of the first degree punishable by
260260 imprisonment in the Texas Department of Criminal Justice for life
261261 or for a term of not more than 99 years or less than 15 years and a
262262 fine not to exceed $250,000, if the number of abuse units of the
263263 controlled substance is 4,000 or more.
264264 SECTION 6. Sections 481.1123(b), (d), (e), and (f), Health
265265 and Safety Code, are amended to read as follows:
266266 (b) An offense under Subsection (a) is a [state jail] felony
267267 of the third degree if the amount of the controlled substance to
268268 which the offense applies is, by aggregate weight, including
269269 adulterants or dilutants, less than one gram.
270270 (d) An offense under Subsection (a) is a felony of the first
271271 degree punishable by imprisonment in the Texas Department of
272272 Criminal Justice for life or for a term of not more than 99 years or
273273 less than 10 years, and a fine not to exceed $20,000, if the amount
274274 of the controlled substance to which the offense applies is, by
275275 aggregate weight, including adulterants or dilutants, four grams or
276276 more but less than 200 grams.
277277 (e) An offense under Subsection (a) is a felony of the first
278278 degree punishable by imprisonment in the Texas Department of
279279 Criminal Justice for life or for a term of not more than 99 years or
280280 less than 15 years, and a fine not to exceed $200,000, if the amount
281281 of the controlled substance to which the offense applies is, by
282282 aggregate weight, including adulterants or dilutants, 200 grams or
283283 more but less than 400 grams.
284284 (f) An offense under Subsection (a) is a felony of the first
285285 degree punishable by imprisonment in the Texas Department of
286286 Criminal Justice for life or for a term of not more than 99 years or
287287 less than 20 years, and a fine not to exceed $500,000, if the amount
288288 of the controlled substance to which the offense applies is, by
289289 aggregate weight, including adulterants or dilutants, 400 grams or
290290 more.
291291 SECTION 7. Section 481.113(e), Health and Safety Code, is
292292 amended to read as follows:
293293 (e) An offense under Subsection (a) is a felony of the first
294294 degree punishable by imprisonment in the Texas Department of
295295 Criminal Justice for life or for a term of not more than 99 years or
296296 less than 10 years, and a fine not to exceed $100,000, if the amount
297297 of the controlled substance to which the offense applies is, by
298298 aggregate weight, including adulterants or dilutants, 400 grams or
299299 more.
300300 SECTION 8. Section 481.114(e), Health and Safety Code, is
301301 amended to read as follows:
302302 (e) An offense under Subsection (a) is a felony of the first
303303 degree punishable by imprisonment in the Texas Department of
304304 Criminal Justice for life or for a term of not more than 99 years or
305305 less than 10 years, and a fine not to exceed $100,000, if the amount

309309 SECTION 9. Section 481.115(f), Health and Safety Code, is

312312 degree punishable by imprisonment in the Texas Department of
313313 Criminal Justice for life or for a term of not more than 99 years or
314314 less than 10 years, and a fine not to exceed $100,000, if the amount
315315 of the controlled substance possessed is, by aggregate weight,
316316 including adulterants or dilutants, 400 grams or more.
317317 SECTION 10. Section 481.1151(b), Health and Safety Code, is
318318 amended to read as follows:
319319 (b) An offense under this section is:
320320 (1) a state jail felony if the number of abuse units of
321321 the controlled substance is fewer than 20;
322322 (2) a felony of the third degree if the number of abuse
323323 units of the controlled substance is 20 or more but fewer than 80;
324324 (3) a felony of the second degree if the number of
325325 abuse units of the controlled substance is 80 or more but fewer than
326326 4,000;
327327 (4) a felony of the first degree if the number of abuse
328328 units of the controlled substance is 4,000 or more but fewer than
329329 8,000; and
330330 (5) a felony of the first degree punishable by
331331 imprisonment in the Texas Department of Criminal Justice for life
332332 or for a term of not more than 99 years or less than 15 years and a
333333 fine not to exceed $250,000, if the number of abuse units of the
334334 controlled substance is 8,000 or more.
335335 SECTION 11. Section 481.116(e), Health and Safety Code, is
336336 amended to read as follows:
337337 (e) An offense under Subsection (a) is a felony of the first
338338 degree punishable by imprisonment in the Texas Department of
339339 Criminal Justice for life or for a term of not more than 99 years or
340340 less than five years, and a fine not to exceed $50,000, if the
341341 amount of the controlled substance possessed is, by aggregate
342342 weight, including adulterants or dilutants, 400 grams or more.
343343 SECTION 12. Section 481.1161(b), Health and Safety Code, is
344344 amended to read as follows:
345345 (b) An offense under this section is:
346346 (1) a Class B misdemeanor if the amount of the
347347 controlled substance possessed is, by aggregate weight, including
348348 adulterants or dilutants, two ounces or less;
349349 (2) a Class A misdemeanor if the amount of the
350350 controlled substance possessed is, by aggregate weight, including
351351 adulterants or dilutants, four ounces or less but more than two
352352 ounces;
353353 (3) a state jail felony if the amount of the controlled
354354 substance possessed is, by aggregate weight, including adulterants
355355 or dilutants, five pounds or less but more than four ounces;
356356 (4) a felony of the third degree if the amount of the
357357 controlled substance possessed is, by aggregate weight, including
358358 adulterants or dilutants, 50 pounds or less but more than 5 pounds;
359359 (5) a felony of the second degree if the amount of the
360360 controlled substance possessed is, by aggregate weight, including
361361 adulterants or dilutants, 2,000 pounds or less but more than 50
362362 pounds; and
363363 (6) a felony of the first degree punishable by
364364 imprisonment in the Texas Department of Criminal Justice for life
365365 or for a term of not more than 99 years or less than 5 years, and a
366366 fine not to exceed $50,000, if the amount of the controlled
367367 substance possessed is, by aggregate weight, including adulterants
368368 or dilutants, more than 2,000 pounds.
369369 SECTION 13. Section 481.117(e), Health and Safety Code, is
370370 amended to read as follows:
371371 (e) An offense under Subsection (a) is a felony of the first
372372 degree punishable by imprisonment in the Texas Department of
373373 Criminal Justice for life or for a term of not more than 99 years or
374374 less than five years, and a fine not to exceed $50,000, if the
375375 amount of the controlled substance possessed is, by aggregate
376376 weight, including adulterants or dilutants, 400 grams or more.
377377 SECTION 14. Section 481.118(e), Health and Safety Code, is
378378 amended to read as follows:
379379 (e) An offense under Subsection (a) is a felony of the first
380380 degree punishable by imprisonment in the Texas Department of
381381 Criminal Justice for life or for a term of not more than 99 years or
382382 less than five years, and a fine not to exceed $50,000, if the
383383 amount of the controlled substance possessed is, by aggregate
384384 weight, including adulterants or dilutants, 400 grams or more.
385385 SECTION 15. Section 481.120(b), Health and Safety Code, is
386386 amended to read as follows:
387387 (b) An offense under Subsection (a) is:
388388 (1) a Class B misdemeanor if the amount of marihuana
389389 delivered is one-fourth ounce or less and the person committing the
390390 offense does not receive remuneration for the marihuana;
391391 (2) a Class A misdemeanor if the amount of marihuana
392392 delivered is one-fourth ounce or less and the person committing the
393393 offense receives remuneration for the marihuana;
394394 (3) a state jail felony if the amount of marihuana
395395 delivered is five pounds or less but more than one-fourth ounce;
396396 (4) a felony of the second degree if the amount of
397397 marihuana delivered is 50 pounds or less but more than five pounds;
398398 (5) a felony of the first degree if the amount of
399399 marihuana delivered is 2,000 pounds or less but more than 50 pounds;
400400 and
401401 (6) a felony of the first degree punishable by
402402 imprisonment in the Texas Department of Criminal Justice for life
403403 or for a term of not more than 99 years or less than 10 years, and a
404404 fine not to exceed $100,000, if the amount of marihuana delivered is
405405 more than 2,000 pounds.
406406 SECTION 16. Section 481.121(b), Health and Safety Code, is
407407 amended to read as follows:
408408 (b) An offense under Subsection (a) is:
409409 (1) a Class B misdemeanor if the amount of marihuana
410410 possessed is two ounces or less;
411411 (2) a Class A misdemeanor if the amount of marihuana
412412 possessed is four ounces or less but more than two ounces;
413413 (3) a state jail felony if the amount of marihuana
414414 possessed is five pounds or less but more than four ounces;
415415 (4) a felony of the third degree if the amount of
416416 marihuana possessed is 50 pounds or less but more than 5 pounds;
417417 (5) a felony of the second degree if the amount of
418418 marihuana possessed is 2,000 pounds or less but more than 50 pounds;
419419 and
420420 (6) a felony of the first degree punishable by
421421 imprisonment in the Texas Department of Criminal Justice for life
422422 or for a term of not more than 99 years or less than 5 years, and a
423423 fine not to exceed $50,000, if the amount of marihuana possessed is
424424 more than 2,000 pounds.
425425 SECTION 17. Section 481.126(a), Health and Safety Code, is
426426 amended to read as follows:
427427 (a) A person commits an offense if the person:
428428 (1) barters property or expends funds the person knows
429429 are derived from the commission of a first degree felony [an]
430430 offense under this chapter punishable by imprisonment in the Texas
431431 Department of Criminal Justice for life;
432432 (2) barters property or expends funds the person knows
433433 are derived from the commission of an offense under Section
434434 481.121(a) that is punishable under Section 481.121(b)(5);
435435 (3) barters property or finances or invests funds the
436436 person knows or believes are intended to further the commission of
437437 an offense for which the punishment is described by Subdivision
438438 (1); or
439439 (4) barters property or finances or invests funds the
440440 person knows or believes are intended to further the commission of
441441 an offense under Section 481.121(a) that is punishable under
442442 Section 481.121(b)(5).
443443 SECTION 18. Section 481.134(c), Health and Safety Code, as
444444 amended by Chapters 584 (S.B. 768) and 807 (H.B. 1540), Acts of the
445445 87th Legislature, Regular Session, 2021, is reenacted and amended
446446 to read as follows:
447447 (c) The minimum term of confinement or imprisonment for an
448448 offense otherwise punishable under Section 481.112(c), (d), (e), or
449449 (f), 481.1121(b)(2), (3), or (4), 481.1123(b), (c) [481.1123(c)],
450450 (d), (e), or (f), 481.113(c), (d), or (e), 481.114(c), (d), or (e),
451451 481.115(c)-(f), 481.1151(b)(2), (3), (4), or (5), 481.116(c), (d),
452452 or (e), 481.1161(b)(4), (5), or (6), 481.117(c), (d), or (e),
453453 481.118(c), (d), or (e), 481.120(b)(4), (5), or (6), or
454454 481.121(b)(4), (5), or (6) is increased by five years and the
455455 maximum fine for the offense is doubled if it is shown on the trial
456456 of the offense that the offense was committed:
457457 (1) in, on, or within 1,000 feet of the premises of a
458458 school, the premises of a public or private youth center, or a
459459 playground;
460460 (2) on a school bus; or
461461 (3) by any unauthorized person 18 years of age or
462462 older, in, on, or within 1,000 feet of premises owned, rented, or
463463 leased by a general residential operation operating as a
464464 residential treatment center.
465465 SECTION 19. Section 481.141, Health and Safety Code, is
466466 amended by adding Subsection (d) to read as follows:
467467 (d) Punishment may not be increased under this section if
468468 the defendant is also prosecuted under Section 19.02(b)(4), Penal
469469 Code, for conduct occurring during the same criminal episode.
470470 SECTION 20. Section 19.02, Penal Code, is amended by
471471 amending Subsection (b) and adding Subsection (e) to read as
472472 follows:
473473 (b) A person commits an offense if the person [he]:
474474 (1) intentionally or knowingly causes the death of an
475475 individual;
476476 (2) intends to cause serious bodily injury and commits
477477 an act clearly dangerous to human life that causes the death of an
478478 individual; [or]
479479 (3) commits or attempts to commit a felony, other than
480480 manslaughter, and in the course of and in furtherance of the
481481 commission or attempt, or in immediate flight from the commission
482482 or attempt, the person [he] commits or attempts to commit an act
483483 clearly dangerous to human life that causes the death of an
484484 individual; or
485485 (4) knowingly manufactures or delivers a controlled
486486 substance included in Penalty Group 1-B under Section 481.1022,
487487 Health and Safety Code, in violation of Section 481.1123, Health
488488 and Safety Code, and an individual dies as a result of injecting,
489489 ingesting, inhaling, or introducing into the individual's body any
490490 amount of the controlled substance manufactured or delivered by the
491491 actor, regardless of whether the controlled substance was used by
492492 itself or with another substance, including a drug, adulterant, or
493493 dilutant.
494494 (e) It is a defense to prosecution under Subsection (b)(4)
495495 that the actor's conduct in manufacturing or delivering the
496496 controlled substance was authorized under Chapter 481, Health and
497497 Safety Code, or other state or federal law.
498498 SECTION 21. Section 71.02(a), Penal Code, is amended to
499499 read as follows:
500500 (a) A person commits an offense if, with the intent to
501501 establish, maintain, or participate in a combination or in the
502502 profits of a combination or as a member of a criminal street gang,
503503 the person commits or conspires to commit one or more of the
504504 following:
505505 (1) murder, capital murder, arson, aggravated
506506 robbery, robbery, burglary, theft, aggravated kidnapping,
507507 kidnapping, aggravated assault, aggravated sexual assault, sexual
508508 assault, continuous sexual abuse of young child or disabled
509509 individual, solicitation of a minor, forgery, deadly conduct,
510510 assault punishable as a Class A misdemeanor, burglary of a motor
511511 vehicle, or unauthorized use of a motor vehicle;
512512 (2) any gambling offense punishable as a Class A
513513 misdemeanor;
514514 (3) promotion of prostitution, aggravated promotion
515515 of prostitution, or compelling prostitution;
516516 (4) unlawful manufacture, transportation, repair, or
517517 sale of firearms or prohibited weapons;
518518 (5) unlawful manufacture, delivery, dispensation, or
519519 distribution of a controlled substance or dangerous drug, or
520520 unlawful possession of a controlled substance or dangerous drug
521521 through forgery, fraud, misrepresentation, or deception;
522522 (5-a) causing the unlawful delivery, dispensation, or
523523 distribution of a controlled substance or dangerous drug in
524524 violation of Subtitle B, Title 3, Occupations Code;
525525 (5-b) unlawful possession with intent to deliver a
526526 controlled substance listed in Penalty Group 1-B under Section
527527 481.1022, Health and Safety Code;
528528 (6) any unlawful wholesale promotion or possession of
529529 any obscene material or obscene device with the intent to wholesale
530530 promote the same;
531531 (7) any offense under Subchapter B, Chapter 43,
532532 depicting or involving conduct by or directed toward a child
533533 younger than 18 years of age;
534534 (8) any felony offense under Chapter 32;
535535 (9) any offense under Chapter 36;
536536 (10) any offense under Chapter 34, 35, or 35A;
537537 (11) any offense under Section 37.11(a);
538538 (12) any offense under Chapter 20A;
539539 (13) any offense under Section 37.10;
540540 (14) any offense under Section 38.06, 38.07, 38.09, or
541541 38.11;
542542 (15) any offense under Section 42.10;
543543 (16) any offense under Section 46.06(a)(1) or 46.14;
544544 (17) any offense under Section 20.05 or 20.06;
545545 (18) any offense under Section 16.02; or
546546 (19) any offense classified as a felony under the Tax
547547 Code.
548548 SECTION 22. The change in law made by this Act to Section
549549 193.005, Health and Safety Code, applies only to a death that occurs
550550 on or after the effective date of this Act, or a death that occurs
551551 before that date but is discovered on or after the effective date of
552552 this Act.
553553 SECTION 23. The changes in law made by this Act to Chapter
554554 481, Health and Safety Code, and Sections 19.02 and 71.02, Penal
555555 Code, apply only to an offense committed on or after the effective
556556 date of this Act. An offense committed before the effective date of
557557 this Act is governed by the law in effect on the date the offense was
558558 committed, and the former law is continued in effect for that
559559 purpose. For purposes of this section, an offense was committed
560560 before the effective date of this Act if any element of the offense
561561 occurred before that date.
562562 SECTION 24. To the extent of any conflict, this Act prevails
563563 over another Act of the 88th Legislature, Regular Session, 2023,
564564 relating to nonsubstantive additions to and corrections in enacted
565565 codes.
566566 SECTION 25. This Act takes effect September 1, 2023.
