77 relating to a limitation on civil suits against persons reporting
88 suspicious activity in good faith.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 6, Civil Practice and Remedies Code, is
1111 amended by adding Chapter 128A to read as follows:
1212 CHAPTER 128A. LIMITATION ON SUITS AGAINST CERTAIN PERSONS
1313 REPORTING SUSPICIOUS ACTIVITY
1414 Sec. 128A.001. LIMITATION ON CIVIL ACTION. A civil action
1515 related to a report of suspicious activity of another person to an
1616 appropriate law enforcement authority may not be brought against
1717 the person who made the report if the person acted:
1818 (1) as a reasonable person would in the same or similar
1919 circumstances; and
2020 (2) with a reasonable belief that the suspicious
2121 activity constituted or was in furtherance of a crime, including an
2222 act of terrorism.
2323 SECTION 2. Section 128A.001, Civil Practice and Remedies
2424 Code, as added by this Act, applies only to a cause of action that
2525 accrues on or after the effective date of this Act.
2626 SECTION 3. This Act takes effect September 1, 2023.
