55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disclosure of negotiated rates requested by members
88 of the legislature from certain health care vendors that contract
99 with this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 2252, Government Code, is
1212 amended by adding Section 2252.909 to read as follows:
1313 Sec. 2252.909. LEGISLATIVE REQUEST FOR NEGOTIATED RATES
1414 UNDER CERTAIN HEALTH BENEFIT CONTRACTS. (a) In this
1515 section, "health care vendor" means:
1616 (1) a health benefit plan issuer that contracts with
1717 this state for the administration of health benefits; and
1818 (2) a managed care organization that contracts with
1919 the Health and Human Services Commission to administer health
2020 benefits for Medicaid recipients through a managed care plan.
2121 (b) This section applies only to a health care vendor that
2222 contracts with this state, including with an agency of this state,
2323 to administer health benefits under:
2424 (1) a basic coverage plan under Chapter 1551,
2525 Insurance Code;
2626 (2) a basic plan under Chapter 1575, Insurance Code;
2727 (3) a primary care coverage plan under Chapter 1579,
2828 Insurance Code;
2929 (4) a plan providing basic coverage under Chapter
3030 1601, Insurance Code; or
3131 (5) the state Medicaid program, including the Medicaid
3232 managed care program operated under Chapter 533.
3333 (c) A member of the legislature may request from a health
3434 care vendor information regarding any negotiated rate included in a
3535 contract between the vendor and this state for the administration
3636 of health benefits.
3737 (d) On receipt of a written request for information under
3838 Subsection (c), the health care vendor shall provide the requested
3939 information to the member of the legislature who submitted the
4040 request.
4141 (e) A health care vendor, by providing information under
4242 this section that is confidential or otherwise excepted from
4343 required disclosure under law, does not waive or affect the
4444 confidentiality of the information for purposes of state or federal
4545 law or waive the right to assert exceptions to required disclosure
4646 of the information in the future.
4747 (f) A member of the legislature or legislative staff who
4848 receives information from a health care vendor under this section
4949 may not disclose that information to any person who does not have a
5050 right to access that information under this section.
5151 SECTION 2. Section 2252.909, Government Code, as added by
5252 this Act, applies only to a health care vendor that enters into or
5353 renews a contract with the State of Texas on or after the effective
5454 date of this Act.
5555 SECTION 3. This Act takes effect September 1, 2023.
