| 5 | 5 | | relating to issuance of specialty license plates to honor fallen |

| 6 | 6 | | law enforcement officers. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter G, Chapter 504, Transportation Code, |
|---|
| 9 | 9 | | is amended by adding Section 504.680 to read as follows: |
|---|
| 10 | 10 | | Sec. 504.680. FALLEN LAW ENFORCEMENT OFFICER LICENSE |
|---|
| 11 | 11 | | PLATES. (a) The department shall issue specialty license plates to |
|---|
| 12 | 12 | | honor law enforcement officers killed in the line of duty. The |
|---|
| 13 | 13 | | license plates must include: |
|---|
| 14 | 14 | | (1) the words "A Hero Remembered Never Dies"; |
|---|
| 15 | 15 | | (2) the words "Honoring Law Enforcement"; and |
|---|
| 16 | 16 | | (3) a depiction of a badge covered by a black mourning |
|---|
| 17 | 17 | | band. |
|---|
| 18 | 18 | | (b) After deduction of the department's administrative |
|---|
| 19 | 19 | | costs, the remainder of the fee for issuance of the license plates |
|---|
| 20 | 20 | | shall be deposited to the credit of an account created by the |
|---|
| 21 | 21 | | comptroller in the manner provided by Section 504.6012(b). Money |
|---|
| 22 | 22 | | deposited to that account may be used only by the Employees |
|---|
| 23 | 23 | | Retirement System of Texas to provide financial assistance to |
|---|
| 24 | 24 | | surviving family members of peace officers killed in the line of |
|---|
| 25 | 25 | | duty under Chapter 615, Government Code. |
|---|
| 26 | 26 | | (c) Section 504.702 does not apply to a specialty license |
|---|
| 27 | 27 | | plate issued under this section. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2023. |
