| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 61.065, Natural Resources Code, is |
|---|
| 9 | 9 | | amended by adding Subsection (e) to read as follows: |
|---|
| 10 | 10 | | (e) Subsection (c)(1) does not apply to a municipality with |
|---|
| 11 | 11 | | a population of less than 1,000 that is located in a county adjacent |
|---|
| 12 | 12 | | to a county with a population of more than 3.3 million. |
|---|
| 13 | 13 | | SECTION 2. Section 61.066, Natural Resources Code, is |
|---|
| 14 | 14 | | amended by adding Subsection (e) to read as follows: |
|---|
| 15 | 15 | | (e) Subsection (b)(1) does not apply to a county adjacent to |
|---|
| 16 | 16 | | a county with a population of more than 3.3 million that contains a |
|---|
| 17 | 17 | | municipality adjacent to the Gulf of Mexico with a population of |
|---|
| 18 | 18 | | less than 1,000. |
|---|
| 19 | 19 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2023. |
