55 AN ACT
66 relating to a severance payment to a superintendent of a school
77 district.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 11.201(c), Education Code, is amended to
1010 read as follows:
1111 (c) For purposes of this subsection, "severance payment"
1212 means any amount paid by the board of trustees of an independent
1313 school district to or in behalf of a superintendent on early
1414 termination of the superintendent's contract that exceeds the
1515 amount earned by the superintendent under the contract as of the
1616 date of termination, including any amount that exceeds the amount
1717 of earned standard salary and benefits that is paid as a condition
1818 of early termination of the contract. The board of trustees may not
1919 make a severance payment to a superintendent. The board of trustees
2020 that makes a severance payment to a superintendent shall report the
2121 terms of the severance payment to the commissioner. [The
2222 commissioner shall reduce the district's Foundation School Program
2323 funds by any amount that the amount of the severance payment to the
2424 superintendent exceeds an amount equal to one year's salary and
2525 benefits under the superintendent's terminated contract.] The
2626 commissioner may adopt rules as necessary to administer this
2727 subsection.
2828 SECTION 2. Section 11.201(c), Education Code, as amended by
2929 this Act, applies only to a severance payment made by the board of
3030 trustees of an independent school district to a superintendent
3131 under an agreement entered into on or after the effective date of
3232 this Act. A severance payment made by the board of trustees of an
3333 independent school district to a superintendent under an agreement
3434 entered into before the effective date of this Act is governed by
3535 the law in effect at the time the agreement was made, and that law is
3636 continued in effect for that purpose.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2023.
