55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to immunity from civil and criminal liability for certain
88 Department of Family and Protective Services contractors who
99 participate in a child abuse or neglect investigation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 261.106(b), Family Code, is amended to
1212 read as follows:
1313 (b) Immunity from civil and criminal liability extends to an
1414 authorized volunteer or contractor of the department or a law
1515 enforcement officer who participates at the request of the
1616 department in an investigation of alleged or suspected abuse or
1717 neglect or in an action arising from an investigation if the person
1818 was acting in good faith and in the scope of the person's
1919 responsibilities.
2020 SECTION 2. This Act takes effect September 1, 2023.
