66 AN ACT
77 relating to the regulation of coin-operated machines.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2153.051, Occupations Code, is amended
1010 by adding Subsections (c), (d), and (e) to read as follows:
1111 (c) Notwithstanding any other provision of this chapter,
1212 the comptroller shall disclose confidential information, including
1313 information contained in a license or registration certificate
1414 application, to a law enforcement agency that submits to the
1515 comptroller a written request for the information in connection
1616 with an investigation the agency is conducting. A peace officer is
1717 an appropriate official for purposes of the disclosure of
1818 information under Subsection (b)(5).
1919 (d) Information disclosed to a law enforcement agency in
2020 accordance with Subsection (c) remains confidential information
2121 under Section 2153.102, and the agency may use the information only
2222 for purposes of the investigation, and any related prosecution, for
2323 which the agency submitted the written request.
2424 (e) In this section, "law enforcement agency" means an
2525 agency of this state or an agency of a political subdivision of this
2626 state authorized by law to employ peace officers.
2727 SECTION 2. Section 2153.305(a), Occupations Code, is
2828 amended to read as follows:
2929 (a) The comptroller may refuse to issue or renew or may
3030 suspend or revoke a license or registration certificate, or a tax
3131 permit or license the comptroller issues to the applicant or
3232 registration certificate holder for a different tax or activity
3333 administered by the comptroller, if:
3434 (1) the applicant or license or registration
3535 certificate holder violates this chapter or a rule adopted under
3636 this chapter;
3737 (2) the applicant or license or registration
3838 certificate holder fails to answer a question or makes a false
3939 statement in, or in connection with, an application;
4040 (3) the applicant or license or registration
4141 certificate holder extends or lends credit without notifying the
4242 commissioner of the person's intent to extend or lend credit [as
4343 required by Section 2153.253];
4444 (4) the applicant or license or registration
4545 certificate holder uses coercion to accomplish a purpose or engage
4646 in conduct regulated by the comptroller; or
4747 (5) the applicant or license or registration
4848 certificate holder enters into a contract or agreement with the
4949 owner of the location of a coin-operated machine and the contract or
5050 agreement contains any kind of restriction relating to the location
5151 owner's right to purchase, agree to purchase, or use a product,
5252 commodity, or service that is not regulated under this chapter.
5353 SECTION 3. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2023.
