7 | 7 | | relating to the regulation of coin-operated machines. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 2153.051, Occupations Code, is amended |
---|
10 | 10 | | by adding Subsections (c), (d), and (e) to read as follows: |
---|
11 | 11 | | (c) Notwithstanding any other provision of this chapter, |
---|
12 | 12 | | the comptroller shall disclose confidential information, including |
---|
13 | 13 | | information contained in a license or registration certificate |
---|
14 | 14 | | application, to a law enforcement agency that submits to the |
---|
15 | 15 | | comptroller a written request for the information in connection |
---|
16 | 16 | | with an investigation the agency is conducting. A peace officer is |
---|
17 | 17 | | an appropriate official for purposes of the disclosure of |
---|
18 | 18 | | information under Subsection (b)(5). |
---|
19 | 19 | | (d) Information disclosed to a law enforcement agency in |
---|
20 | 20 | | accordance with Subsection (c) remains confidential information |
---|
21 | 21 | | under Section 2153.102, and the agency may use the information only |
---|
22 | 22 | | for purposes of the investigation, and any related prosecution, for |
---|
23 | 23 | | which the agency submitted the written request. |
---|
24 | 24 | | (e) In this section, "law enforcement agency" means an |
---|
25 | 25 | | agency of this state or an agency of a political subdivision of this |
---|
26 | 26 | | state authorized by law to employ peace officers. |
---|
27 | 27 | | SECTION 2. Section 2153.305(a), Occupations Code, is |
---|
28 | 28 | | amended to read as follows: |
---|
29 | 29 | | (a) The comptroller may refuse to issue or renew or may |
---|
30 | 30 | | suspend or revoke a license or registration certificate, or a tax |
---|
31 | 31 | | permit or license the comptroller issues to the applicant or |
---|
32 | 32 | | registration certificate holder for a different tax or activity |
---|
33 | 33 | | administered by the comptroller, if: |
---|
34 | 34 | | (1) the applicant or license or registration |
---|
35 | 35 | | certificate holder violates this chapter or a rule adopted under |
---|
36 | 36 | | this chapter; |
---|
37 | 37 | | (2) the applicant or license or registration |
---|
38 | 38 | | certificate holder fails to answer a question or makes a false |
---|
39 | 39 | | statement in, or in connection with, an application; |
---|
40 | 40 | | (3) the applicant or license or registration |
---|
41 | 41 | | certificate holder extends or lends credit without notifying the |
---|
42 | 42 | | commissioner of the person's intent to extend or lend credit [as |
---|
43 | 43 | | required by Section 2153.253]; |
---|
44 | 44 | | (4) the applicant or license or registration |
---|
45 | 45 | | certificate holder uses coercion to accomplish a purpose or engage |
---|
46 | 46 | | in conduct regulated by the comptroller; or |
---|
47 | 47 | | (5) the applicant or license or registration |
---|
48 | 48 | | certificate holder enters into a contract or agreement with the |
---|
49 | 49 | | owner of the location of a coin-operated machine and the contract or |
---|
50 | 50 | | agreement contains any kind of restriction relating to the location |
---|
51 | 51 | | owner's right to purchase, agree to purchase, or use a product, |
---|
52 | 52 | | commodity, or service that is not regulated under this chapter. |
---|
53 | 53 | | SECTION 3. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2023. |
