66 AN ACT
77 relating to electronic voter registration.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1010 amended by adding Section 13.009 to read as follows:
1111 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1212 secretary of state shall work with the Department of Public Safety
1313 and the Department of Information Resources to implement a program
1414 to allow a person to complete a voter registration application over
1515 the Internet from the official website of this state. The Internet
1616 websites of the secretary of state and the Department of Public
1717 Safety must also provide a link to the location of the application
1818 on the official website of this state.
1919 (b) An applicant for electronic voter registration who has
2020 an unexpired driver's license or personal identification card
2121 issued in this state must:
2222 (1) attest to the truth of the information provided on
2323 the application by affirmatively accepting the information as true;
2424 and
2525 (2) affirmatively consent to the use of the signature
2626 on the applicant's driver's license or personal identification card
2727 for voter registration purposes.
2828 (c) An applicant for electronic voter registration who does
2929 not have an unexpired driver's license or personal identification
3030 card issued in this state must:
3131 (1) attest to the truth of the information provided on
3232 the application by affirmatively accepting the information as true;
3333 and
3434 (2) digitally sign the applicant's application before
3535 submitting it electronically.
3636 (d) For each application submitted under Subsection (b),
3737 the program shall require that a digital copy of the applicant's
3838 signature be obtained from the Department of Public Safety.
3939 (e) A digital signature given as provided by secretary of
4040 state rule meets the signature requirement under Section 13.002(b).
4141 An application submitted under this section is considered for all
4242 purposes an application submitted by mail under this title.
4343 (f) The secretary of state shall adopt rules as necessary to
4444 implement this section, including rules to provide for additional
4545 security measures necessary to ensure the accuracy and integrity of
4646 applications submitted electronically.
4747 (g) The rules adopted under Subsection (f) must require
4848 that:
4949 (1) the Internet website through which a person may
5050 complete a voter registration application include a description of
5151 the offense described by Section 13.007 in a conspicuous location
5252 on the website near the place where the person begins or submits the
5353 application; and
5454 (2) the state electronic Internet portal project be
5555 used to authenticate the identity and address of a person who
5656 submits an application electronically under this section.
5757 SECTION 2. This Act takes effect September 1, 2023.
