24 | 24 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

25 | 25 | | SECTION 1. Section 846.258(b), Insurance Code, is amended |
---|
26 | 26 | | to read as follows: |
---|
27 | 27 | | (b) Coverage of a newborn child of a participating employee |
---|
28 | 28 | | under this section ends on the 61st [32nd] day after the date of the |
---|
29 | 29 | | child's birth unless: |
---|
30 | 30 | | (1) children are eligible for coverage under the |
---|
31 | 31 | | multiple employer welfare arrangement's plan document; and |
---|
32 | 32 | | (2) not later than the 60th [31st] day after the date |
---|
33 | 33 | | of birth, the arrangement receives: |
---|
34 | 34 | | (A) notice of the birth; and |
---|
35 | 35 | | (B) any required additional premium. |
---|
36 | 36 | | SECTION 2. Section 1501.157(b), Insurance Code, is amended |
---|
37 | 37 | | to read as follows: |
---|
38 | 38 | | (b) Coverage of a newborn child of a covered employee under |
---|
39 | 39 | | this section ends on the 61st [32nd] day after the date of the |
---|
40 | 40 | | child's birth unless, not later than the 60th [31st] day after the |
---|
41 | 41 | | date of birth, the small employer health benefit plan issuer |
---|
42 | 42 | | receives: |
---|
43 | 43 | | (1) notice of the birth; and |
---|
44 | 44 | | (2) any required additional premium. |
---|
45 | 45 | | SECTION 3. Section 1501.607(b), Insurance Code, is amended |
---|
46 | 46 | | to read as follows: |
---|
47 | 47 | | (b) Coverage of a newborn child of a covered employee under |
---|
48 | 48 | | this section ends on the 61st [32nd] day after the date of the |
---|
49 | 49 | | child's birth unless: |
---|
50 | 50 | | (1) children are eligible for coverage under the large |
---|
51 | 51 | | employer health benefit plan; and |
---|
52 | 52 | | (2) not later than the 60th [31st] day after the date |
---|
53 | 53 | | of birth, the large employer health benefit plan issuer receives: |
---|
54 | 54 | | (A) notice of the birth; and |
---|
55 | 55 | | (B) any required additional premium. |
---|
56 | 56 | | SECTION 4. The change in law made by this Act applies only |
---|
57 | 57 | | to a health benefit plan that is delivered, issued for delivery, or |
---|
58 | 58 | | renewed on or after January 1, 2024. A health benefit plan that is |
---|
59 | 59 | | delivered, issued for delivery, or renewed before January 1, 2024, |
---|
60 | 60 | | is governed by the law as it existed immediately before the |
---|
61 | 61 | | effective date of this Act, and that law is continued in effect for |
---|
62 | 62 | | that purpose. |
---|
63 | 63 | | SECTION 5. This Act takes effect September 1, 2023. |
