2121 AN ACT
2222 relating to the enrollment period for newborns under certain
2323 employer health benefit plans.
2424 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2525 SECTION 1. Section 846.258(b), Insurance Code, is amended
2626 to read as follows:
2727 (b) Coverage of a newborn child of a participating employee
2828 under this section ends on the 61st [32nd] day after the date of the
2929 child's birth unless:
3030 (1) children are eligible for coverage under the
3131 multiple employer welfare arrangement's plan document; and
3232 (2) not later than the 60th [31st] day after the date
3333 of birth, the arrangement receives:
3434 (A) notice of the birth; and
3535 (B) any required additional premium.
3636 SECTION 2. Section 1501.157(b), Insurance Code, is amended
3737 to read as follows:
3838 (b) Coverage of a newborn child of a covered employee under
3939 this section ends on the 61st [32nd] day after the date of the
4040 child's birth unless, not later than the 60th [31st] day after the
4141 date of birth, the small employer health benefit plan issuer
4242 receives:
4343 (1) notice of the birth; and
4444 (2) any required additional premium.
4545 SECTION 3. Section 1501.607(b), Insurance Code, is amended
4646 to read as follows:
4747 (b) Coverage of a newborn child of a covered employee under
4848 this section ends on the 61st [32nd] day after the date of the
4949 child's birth unless:
5050 (1) children are eligible for coverage under the large
5151 employer health benefit plan; and
5252 (2) not later than the 60th [31st] day after the date
5353 of birth, the large employer health benefit plan issuer receives:
5454 (A) notice of the birth; and
5555 (B) any required additional premium.
5656 SECTION 4. The change in law made by this Act applies only
5757 to a health benefit plan that is delivered, issued for delivery, or
5858 renewed on or after January 1, 2024. A health benefit plan that is
5959 delivered, issued for delivery, or renewed before January 1, 2024,
6060 is governed by the law as it existed immediately before the
6161 effective date of this Act, and that law is continued in effect for
6262 that purpose.
6363 SECTION 5. This Act takes effect September 1, 2023.
