77 relating to the establishment of a program for the issuance of
88 digital identification.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 7, Transportation Code, is
1111 amended by adding Chapter 526 to read as follows:
1212 CHAPTER 526. DIGITAL IDENTIFICATION PROGRAM
1313 Sec. 526.0101. DEFINITIONS. In this chapter:
1414 (1) "Department" and "driver's license" have the
1515 meanings assigned by Section 521.001.
1616 (2) "Digital identification" includes a digital
1717 driver's license, a digital personal identification certificate, a
1818 digital handgun license, a digital hunting or fishing license, and
1919 a digital license issued by the Department of Public Safety under
2020 Chapter 1702, Occupations Code.
2121 (3) "Handgun license" means a license to carry a
2222 handgun issued under Subchapter H, Chapter 411, Government Code.
2323 (4) "Hunting or fishing license" means a noncommercial
2424 hunting or fishing license of any type issued by the Parks and
2525 Wildlife Department, including:
2626 (A) a hunting license issued under Chapter 42,
2727 Parks and Wildlife Code;
2828 (B) a fishing license issued under Chapter 46,
2929 Parks and Wildlife Code; or
3030 (C) a combination hunting and fishing license
3131 issued under Chapter 50, Parks and Wildlife Code.
3232 Sec. 526.0102. DIGITAL IDENTIFICATION PROGRAM. (a) The
3333 department, in consultation with the Parks and Wildlife Department,
3434 by rule shall establish a program for the issuance of digital
3535 identification.
3636 (b) In establishing the digital identification program, the
3737 department shall:
3838 (1) assess existing department infrastructure and
3939 upgrade department infrastructure according to the department's
4040 findings;
4141 (2) provide a digital identification solution that:
4242 (A) is capable of presenting digital
4343 identification on a wireless communication device that:
4444 (i) must include the information included
4545 on a driver's license, as described by Section 521.121(a); and
4646 (ii) may include, as applicable:
4747 (a) the information included on a
4848 handgun license, as required by Subchapter H, Chapter 411,
4949 Government Code;
5050 (b) the information included on a
5151 hunting or fishing license, as required by the Parks and Wildlife
5252 Code, including a stamp or other authorization issued by the Parks
5353 and Wildlife Department in connection with the hunting or fishing
5454 license; and
5555 (c) the information included on a
5656 license issued by the Department of Public Safety under Chapter
5757 1702, Occupations Code;
5858 (B) includes an authentication and verification
5959 process for a wireless communication device; and
6060 (C) may be used in any location regardless of the
6161 location's level of wireless connectivity or cellular telephone
6262 service;
6363 (3) deploy the digital identification solution; and
6464 (4) implement any procedures necessary to allow law
6565 enforcement officials to accept digital identification.
6666 (c) The department may not charge a fee for the issuance of
6767 digital identification under this section.
6868 (d) If an applicant is eligible for a form of identification
6969 described by Subsection (b), the department or the Parks and
7070 Wildlife Department, as applicable, shall:
7171 (1) issue the applicant a physical version of the
7272 identification; and
7373 (2) on request, issue the applicant digital
7474 identification under this section.
7575 (e) Digital identification issued under this section may
7676 not be used for voting purposes.
7777 SECTION 2. (a) The Department of Public Safety by rule
7878 shall establish the digital identification program under Chapter
7979 526, Transportation Code, as added by this Act, not later than
8080 February 1, 2025.
8181 (b) If before implementing any provision of this Act the
8282 Department of Public Safety determines that a waiver or
8383 authorization from a federal agency is necessary for the
8484 implementation of that provision, the Department of Public Safety
8585 shall request the waiver or authorization and may delay
8686 implementing that provision until the waiver or authorization is
8787 granted.
8888 SECTION 3. This Act takes effect immediately if it receives
8989 a vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution. If this
9191 Act does not receive the vote necessary for immediate effect, this
9292 Act takes effect September 1, 2023.
