66 AN ACT
77 relating to the procedure for certain complaints against health
88 care practitioners.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 112, Occupations Code, is amended by
1111 adding Subchapter C to read as follows:
1212 SUBCHAPTER C. COMPLAINT REFERRALS
1313 Sec. 112.101. COMPLAINTS AGAINST HEALTH CARE PRACTITIONER
1414 LICENSED BY DIFFERENT LICENSING ENTITY. (a) Notwithstanding any
1515 other law, a licensing entity that receives a complaint concerning
1616 a health care practitioner who holds a license issued by a different
1717 licensing entity shall promptly forward a copy of the complaint to
1818 that licensing entity.
1919 (b) A licensing entity may not take disciplinary action
2020 based on a complaint against a health care practitioner who holds a
2121 license issued by a different licensing entity unless that
2222 licensing entity refers the complaint back to the licensing entity
2323 that received the complaint for investigation and resolution.
2424 SECTION 2. The changes in law made by this Act apply only to
2525 a complaint filed against a health care practitioner on or after the
2626 effective date of this Act. A complaint filed before the effective
2727 date of this Act is governed by the law in effect on the date the
2828 complaint was filed, and the former law is continued in effect for
2929 that purpose.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2023.
