| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 130, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 130.01015 to read as follows: |
|---|
| 12 | 12 | | Sec. 130.01015. DISPOSITION OF CERTAIN LIBRARY MATERIALS. |
|---|
| 13 | 13 | | (a) In this section, "library materials" means periodicals, books, |
|---|
| 14 | 14 | | e-books, tapes, and other media. |
|---|
| 15 | 15 | | (b) Notwithstanding any other law, a public junior college |
|---|
| 16 | 16 | | library may donate library materials to any person or organization |
|---|
| 17 | 17 | | if the library materials: |
|---|
| 18 | 18 | | (1) as determined by library staff: |
|---|
| 19 | 19 | | (A) duplicate library materials that are a part |
|---|
| 20 | 20 | | of the library's collection; or |
|---|
| 21 | 21 | | (B) are no longer appropriate for inclusion in |
|---|
| 22 | 22 | | the library's collection due to age, condition, or obsolete |
|---|
| 23 | 23 | | content; and |
|---|
| 24 | 24 | | (2) have little or no monetary value. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
