| 8 | 8 | | permits issued by the Texas Commission on Environmental Quality. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 5.554, Water Code, is amended to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | Sec. 5.554. PUBLIC MEETING. (a) During the public comment |
|---|
| 13 | 13 | | period, the executive director may hold one or more public meetings |
|---|
| 14 | 14 | | in the county in which the facility is located or proposed to be |
|---|
| 15 | 15 | | located. The executive director shall hold a public meeting: |
|---|
| 16 | 16 | | (1) on the request of a member of the legislature who |
|---|
| 17 | 17 | | represents the general area in which the facility is located or |
|---|
| 18 | 18 | | proposed to be located; or |
|---|
| 19 | 19 | | (2) if the executive director determines that there is |
|---|
| 20 | 20 | | substantial public interest in the proposed activity. |
|---|
| 21 | 21 | | (b) A public meeting requested under Subsection (a)(1) |
|---|
| 22 | 22 | | shall be held in the house district in which the facility or |
|---|
| 23 | 23 | | proposed facility is located or proposed to be located. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act does not apply |
|---|
| 25 | 25 | | to a public meeting held under Section 5.554, Water Code, as amended |
|---|
| 26 | 26 | | by this Act, for which the location of the public meeting was |
|---|
| 27 | 27 | | determined before the effective date of this Act. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
