55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a task force to study access to legal services for
88 persons with disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. TASK FORCE. (a) In this section:
1111 (1) "Disability" means, with respect to an individual,
1212 a mental or physical impairment that substantially limits at least
1313 one major life activity of that individual.
1414 (2) "Executive commissioner" means the executive
1515 commissioner of the Health and Human Services Commission.
1616 (3) "Task force" means the task force established by
1717 this section.
1818 (b) The executive commissioner shall establish a task force
1919 to study access to legal services for persons with disabilities.
2020 (c) The task force is composed of seven members as follows:
2121 (1) five members appointed by the executive
2222 commissioner, including:
2323 (A) at least two members who are adults with
2424 disabilities; and
2525 (B) at least two members who are parents of
2626 children with disabilities; and
2727 (2) two members who represent Disability Rights Texas.
2828 (d) The executive commissioner shall designate a task force
2929 member as the presiding officer of the task force.
3030 (e) The task force shall meet at least quarterly at the call
3131 of the presiding officer and at other times the presiding officer
3232 determines.
3333 (f) The task force shall study access to legal services for
3434 persons with disabilities. The study must examine and make
3535 recommendations regarding:
3636 (1) the availability of legal representation for
3737 persons with disabilities;
3838 (2) the availability of advocacy and legal services
3939 for persons with disabilities; and
4040 (3) the barriers to accessing legal services for
4141 persons with disabilities, including communication, financial,
4242 medical, and cognitive barriers.
4343 (g) The task force shall develop and submit a written report
4444 of the study and recommendations developed by the task force to the
4545 Health and Human Services Commission, the governor, the lieutenant
4646 governor, the speaker of the house of representatives, and each
4747 member of the legislature not later than December 1, 2024.
4848 (h) The task force may develop instructional and training
4949 materials for legal professionals and persons with disabilities
5050 relating to legal issues affecting persons with disabilities.
5151 (i) The task force may partner with or seek and accept
5252 assistance from voluntary organizations active in supporting
5353 persons with disabilities.
5454 (j) The task force is abolished and this Act expires June 1,
5555 2025.
5656 SECTION 2. EFFECTIVE DATE. This Act takes effect
5757 immediately if it receives a vote of two-thirds of all the members
5858 elected to each house, as provided by Section 39, Article III, Texas
5959 Constitution. If this Act does not receive the vote necessary for
6060 immediate effect, this Act takes effect September 1, 2023.
