55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of a work group to conduct a study on
88 the feasibility of implementing an acute psychiatric bed registry.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section:
1111 (1) "Commission" means the Health and Human Services
1212 Commission.
1313 (2) "Executive commissioner" means the executive
1414 commissioner of the commission.
1515 (3) "Inpatient mental health facility" has the meaning
1616 assigned by Section 571.003, Health and Safety Code.
1717 (b) The commission shall establish a work group to conduct a
1818 study on the feasibility of implementing a statewide or regional
1919 acute psychiatric bed registry to list available beds at inpatient
2020 mental health facilities for the inpatient psychiatric treatment of
2121 certain individuals.
2222 (c) The work group consists of the following members
2323 appointed by the executive commissioner unless otherwise provided:
2424 (1) one member with appropriate expertise appointed by
2525 the governor;
2626 (2) two members with appropriate expertise appointed
2727 by the lieutenant governor;
2828 (3) two members with appropriate expertise appointed
2929 by the speaker of the house of representatives;
3030 (4) the chair of the Texas Hospital Association or the
3131 chair's designee;
3232 (5) the president of the Texas Medical Association or
3333 the president's designee;
3434 (6) the president of the Texas Nurses Association or
3535 the president's designee;
3636 (7) two members who are experts in the field of
3737 technology;
3838 (8) one member who is a licensed psychiatrist;
3939 (9) one member who is a licensed professional
4040 counselor, as defined by Section 503.002, Occupations Code;
4141 (10) one member who works in a substance use treatment
4242 facility;
4343 (11) one member who is a representative of a hospital
4444 located in a rural area of this state;
4545 (12) one member who is a representative of a hospital
4646 located in a county with a population of four million or more;
4747 (13) one member who is a representative of a hospital
4848 located in an urban area of this state in a county with a population
4949 of less than four million;
5050 (14) one member who is a representative of a public
5151 hospital;
5252 (15) one member who is a representative of a private
5353 hospital;
5454 (16) one member who is a statistician;
5555 (17) one member who is a public health expert; and
5656 (18) any other member with appropriate expertise as
5757 the executive commissioner determines necessary.
5858 (d) The work group shall elect from among the membership a
5959 presiding officer.
6060 (e) The work group shall meet periodically and at the call
6161 of the presiding officer.
6262 (f) Not later than September 1, 2024, the commission shall
6363 prepare and submit to each standing committee of the senate and
6464 house of representatives having primary jurisdiction over mental
6565 health a written report that summarizes the results of the study
6666 conducted under this section. The report must:
6767 (1) evaluate the effect of bed registries;
6868 (2) include recommendations for increasing public
6969 awareness of bed registries;
7070 (3) include recommendations for leveraging financial
7171 incentives and legislative, regulatory, or contractual mechanisms
7272 to expedite the entry of data for bed registries;
7373 (4) assess the effect of hospital reimbursements in
7474 increasing bed availability;
7575 (5) evaluate psychiatric treatment capacity in
7676 relation to bed availability; and
7777 (6) include any other information the commission
7878 considers necessary.
7979 (g) The work group is abolished and this section expires
8080 September 1, 2025.
8181 SECTION 2. As soon as practicable after the effective date
8282 of this Act, the applicable appointing authorities shall appoint
8383 the members to the work group established by this Act.
8484 SECTION 3. This Act takes effect September 1, 2023.
