| 7 | 7 | | relating to the establishment of a work group to conduct a study on |
|---|
| 8 | 8 | | the feasibility of implementing an acute psychiatric bed registry. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. (a) In this section: |
|---|
| 11 | 11 | | (1) "Commission" means the Health and Human Services |
|---|
| 12 | 12 | | Commission. |
|---|
| 13 | 13 | | (2) "Executive commissioner" means the executive |
|---|
| 14 | 14 | | commissioner of the commission. |
|---|
| 15 | 15 | | (3) "Inpatient mental health facility" has the meaning |
|---|
| 16 | 16 | | assigned by Section 571.003, Health and Safety Code. |
|---|
| 17 | 17 | | (b) The commission shall establish a work group to conduct a |
|---|
| 18 | 18 | | study on the feasibility of implementing a statewide or regional |
|---|
| 19 | 19 | | acute psychiatric bed registry to list available beds at inpatient |
|---|
| 20 | 20 | | mental health facilities for the inpatient psychiatric treatment of |
|---|
| 21 | 21 | | certain individuals. |
|---|
| 22 | 22 | | (c) The work group consists of the following members |
|---|
| 23 | 23 | | appointed by the executive commissioner unless otherwise provided: |
|---|
| 24 | 24 | | (1) one member with appropriate expertise appointed by |
|---|
| 25 | 25 | | the governor; |
|---|
| 26 | 26 | | (2) two members with appropriate expertise appointed |
|---|
| 27 | 27 | | by the lieutenant governor; |
|---|
| 28 | 28 | | (3) two members with appropriate expertise appointed |
|---|
| 29 | 29 | | by the speaker of the house of representatives; |
|---|
| 30 | 30 | | (4) the chair of the Texas Hospital Association or the |
|---|
| 31 | 31 | | chair's designee; |
|---|
| 32 | 32 | | (5) the president of the Texas Medical Association or |
|---|
| 33 | 33 | | the president's designee; |
|---|
| 34 | 34 | | (6) the president of the Texas Nurses Association or |
|---|
| 35 | 35 | | the president's designee; |
|---|
| 36 | 36 | | (7) two members who are experts in the field of |
|---|
| 37 | 37 | | technology; |
|---|
| 38 | 38 | | (8) one member who is a licensed psychiatrist; |
|---|
| 39 | 39 | | (9) one member who is a licensed professional |
|---|
| 40 | 40 | | counselor, as defined by Section 503.002, Occupations Code; |
|---|
| 41 | 41 | | (10) one member who works in a substance use treatment |
|---|
| 42 | 42 | | facility; |
|---|
| 43 | 43 | | (11) one member who is a representative of a hospital |
|---|
| 44 | 44 | | located in a rural area of this state; |
|---|
| 45 | 45 | | (12) one member who is a representative of a hospital |
|---|
| 46 | 46 | | located in a county with a population of four million or more; |
|---|
| 47 | 47 | | (13) one member who is a representative of a hospital |
|---|
| 48 | 48 | | located in an urban area of this state in a county with a population |
|---|
| 49 | 49 | | of less than four million; |
|---|
| 50 | 50 | | (14) one member who is a representative of a public |
|---|
| 51 | 51 | | hospital; |
|---|
| 52 | 52 | | (15) one member who is a representative of a private |
|---|
| 53 | 53 | | hospital; |
|---|
| 54 | 54 | | (16) one member who is a statistician; |
|---|
| 55 | 55 | | (17) one member who is a public health expert; and |
|---|
| 56 | 56 | | (18) any other member with appropriate expertise as |
|---|
| 57 | 57 | | the executive commissioner determines necessary. |
|---|
| 58 | 58 | | (d) The work group shall elect from among the membership a |
|---|
| 59 | 59 | | presiding officer. |
|---|
| 60 | 60 | | (e) The work group shall meet periodically and at the call |
|---|
| 61 | 61 | | of the presiding officer. |
|---|
| 62 | 62 | | (f) Not later than September 1, 2024, the commission shall |
|---|
| 63 | 63 | | prepare and submit to each standing committee of the senate and |
|---|
| 64 | 64 | | house of representatives having primary jurisdiction over mental |
|---|
| 65 | 65 | | health a written report that summarizes the results of the study |
|---|
| 66 | 66 | | conducted under this section. The report must: |
|---|
| 67 | 67 | | (1) evaluate the effect of bed registries; |
|---|
| 68 | 68 | | (2) include recommendations for increasing public |
|---|
| 69 | 69 | | awareness of bed registries; |
|---|
| 70 | 70 | | (3) include recommendations for leveraging financial |
|---|
| 71 | 71 | | incentives and legislative, regulatory, or contractual mechanisms |
|---|
| 72 | 72 | | to expedite the entry of data for bed registries; |
|---|
| 73 | 73 | | (4) assess the effect of hospital reimbursements in |
|---|
| 74 | 74 | | increasing bed availability; |
|---|
| 75 | 75 | | (5) evaluate psychiatric treatment capacity in |
|---|
| 76 | 76 | | relation to bed availability; and |
|---|
| 77 | 77 | | (6) include any other information the commission |
|---|
| 78 | 78 | | considers necessary. |
|---|
| 79 | 79 | | (g) The work group is abolished and this section expires |
|---|
| 80 | 80 | | September 1, 2025. |
|---|
| 81 | 81 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 82 | 82 | | of this Act, the applicable appointing authorities shall appoint |
|---|
| 83 | 83 | | the members to the work group established by this Act. |
|---|
| 84 | 84 | | SECTION 3. This Act takes effect September 1, 2023. |
|---|
