77 relating to limitations on the use of administrative segregation by
88 the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 501, Government Code, is
1111 amended by adding Section 501.115 to read as follows:
1212 Sec. 501.115. LIMITATION ON USE OF ADMINISTRATIVE
1313 SEGREGATION. (a) In this section, "serious bodily injury" has the
1414 meaning assigned by Section 1.07, Penal Code.
1515 (b) Except as provided by Subsection (c), the department may
1616 not confine an inmate in administrative segregation for more than
1717 three consecutive days based on misconduct by the inmate.
1818 (c) The department may confine an inmate in administrative
1919 segregation for not more than 10 consecutive days for engaging in
2020 conduct that resulted in serious bodily injury to another person.
2121 SECTION 2. The change in law made by this Act applies to any
2222 inmate who is confined in a facility operated by or under contract
2323 with the Texas Department of Criminal Justice on or after the
2424 effective date of this Act, regardless of whether the offense for
2525 which the inmate is confined occurred before, on, or after the
2626 effective date of this Act.
2727 SECTION 3. This Act takes effect September 1, 2023.
