| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 501, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 501.115 to read as follows: |
|---|
| 12 | 12 | | Sec. 501.115. LIMITATION ON USE OF ADMINISTRATIVE |
|---|
| 13 | 13 | | SEGREGATION. (a) In this section, "serious bodily injury" has the |
|---|
| 14 | 14 | | meaning assigned by Section 1.07, Penal Code. |
|---|
| 15 | 15 | | (b) Except as provided by Subsection (c), the department may |
|---|
| 16 | 16 | | not confine an inmate in administrative segregation for more than |
|---|
| 17 | 17 | | three consecutive days based on misconduct by the inmate. |
|---|
| 18 | 18 | | (c) The department may confine an inmate in administrative |
|---|
| 19 | 19 | | segregation for not more than 10 consecutive days for engaging in |
|---|
| 20 | 20 | | conduct that resulted in serious bodily injury to another person. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies to any |
|---|
| 22 | 22 | | inmate who is confined in a facility operated by or under contract |
|---|
| 23 | 23 | | with the Texas Department of Criminal Justice on or after the |
|---|
| 24 | 24 | | effective date of this Act, regardless of whether the offense for |
|---|
| 25 | 25 | | which the inmate is confined occurred before, on, or after the |
|---|
| 26 | 26 | | effective date of this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2023. |
