12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Title 7, Government Code, is amended by adding |
---|
14 | 14 | | Chapter 794 to read as follows: |
---|
15 | 15 | | CHAPTER 794. INTERSTATE COMPACT FOR BORDER SECURITY |
---|
16 | 16 | | Sec. 794.001. AUTHORITY TO DEVELOP AND EXECUTE COMPACT. On |
---|
17 | 17 | | behalf of this state, the governor shall develop and execute an |
---|
18 | 18 | | interstate compact for border security among interested states. |
---|
19 | 19 | | Sec. 794.002. CONGRESSIONAL APPROVAL NOT REQUIRED. (a) It |
---|
20 | 20 | | is the intent of the legislature that the compact developed and |
---|
21 | 21 | | executed under this chapter not require congressional approval. |
---|
22 | 22 | | (b) The compact may not increase the political power of the |
---|
23 | 23 | | compacting states in relation to the federal government. |
---|
24 | 24 | | Sec. 794.003. INTERSTATE COMPACT PROVISIONS. The compact |
---|
25 | 25 | | authorized by this chapter must provide for joint action among |
---|
26 | 26 | | compacting states on matters that include: |
---|
27 | 27 | | (1) sharing law enforcement intelligence on illegal |
---|
28 | 28 | | activity occurring at the border with Mexico; |
---|
29 | 29 | | (2) sharing state resources in order to build a |
---|
30 | 30 | | physical barrier, a comprehensive technological surveillance |
---|
31 | 31 | | system, or both, on state land to deter or detect illegal activity |
---|
32 | 32 | | occurring at the border with Mexico; and |
---|
33 | 33 | | (3) sharing other law enforcement resources to ensure |
---|
34 | 34 | | the protection of personnel and property. |
---|
35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
---|
36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
---|
37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
---|
39 | 39 | | Act takes effect September 1, 2023. |
