88 AN ACT
99 relating to an interstate compact for border security, including
1010 building a border wall and sharing state intelligence and
1111 resources.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Title 7, Government Code, is amended by adding
1414 Chapter 794 to read as follows:
1515 CHAPTER 794. INTERSTATE COMPACT FOR BORDER SECURITY
1616 Sec. 794.001. AUTHORITY TO DEVELOP AND EXECUTE COMPACT. On
1717 behalf of this state, the governor shall develop and execute an
1818 interstate compact for border security among interested states.
1919 Sec. 794.002. CONGRESSIONAL APPROVAL NOT REQUIRED. (a) It
2020 is the intent of the legislature that the compact developed and
2121 executed under this chapter not require congressional approval.
2222 (b) The compact may not increase the political power of the
2323 compacting states in relation to the federal government.
2424 Sec. 794.003. INTERSTATE COMPACT PROVISIONS. The compact
2525 authorized by this chapter must provide for joint action among
2626 compacting states on matters that include:
2727 (1) sharing law enforcement intelligence on illegal
2828 activity occurring at the border with Mexico;
2929 (2) sharing state resources in order to build a
3030 physical barrier, a comprehensive technological surveillance
3131 system, or both, on state land to deter or detect illegal activity
3232 occurring at the border with Mexico; and
3333 (3) sharing other law enforcement resources to ensure
3434 the protection of personnel and property.
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2023.
