77 relating to imposing an additional fee for the registration of
88 electric and hybrid vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 502.198(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) Except as provided by Sections 502.058, 502.060,
1313 502.1911, 502.192, 502.356, [and] 502.357, and 502.360 and
1414 Subchapter H, this section applies to all fees collected by a county
1515 assessor-collector under this chapter.
1616 SECTION 2. Subchapter G, Chapter 502, Transportation Code,
1717 is amended by adding Section 502.360 to read as follows:
1818 Sec. 502.360. ADDITIONAL FEE FOR ELECTRIC AND HYBRID
1919 VEHICLES. (a) In this section:
2020 (1) "Electric vehicle" means a motor vehicle that uses
2121 electricity as its only source of motor power.
2222 (2) "Hybrid vehicle" means a motor vehicle that uses
2323 gasoline or conventional diesel fuel and electricity as its sources
2424 of motor power.
2525 (b) In addition to other fees authorized under this chapter,
2626 at the time of application for registration or renewal of
2727 registration of an electric vehicle or hybrid vehicle, the
2828 applicant shall pay an additional fee of:
2929 (1) $200, if the vehicle is an electric vehicle; or
3030 (2) $100, if the vehicle is a hybrid vehicle.
3131 (c) Fees collected under this section must be deposited to
3232 the credit of the state highway fund, except that 10 percent of the
3333 fees collected under this section must be deposited to the credit of
3434 the electric vehicle battery disposal account created under
3535 Subsection (d).
3636 (d) The electric vehicle battery disposal account is
3737 created as an account in the general revenue fund and shall be
3838 administered by the Texas Commission on Environmental Quality.
3939 Money in the account may be used only by the Texas Commission on
4040 Environmental Quality to reimburse costs incurred by this state or
4141 political subdivisions of this state that are associated with the
4242 disposal of electric vehicle batteries.
4343 SECTION 3. This Act takes effect September 1, 2023.
