66 AN ACT
77 relating to conditions applicable to health benefit plan coverage
88 of in vitro fertilization procedures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1366.005, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 1366.005. CONDITIONS APPLICABLE TO COVERAGE. The
1313 coverage offered under Section 1366.003 is required only if:
1414 (1) the patient for the in vitro fertilization
1515 procedure is an individual covered under the group health benefit
1616 plan;
1717 (2) [the fertilization or attempted fertilization of
1818 the patient's oocytes is made only with the sperm of the patient's
1919 spouse;
2020 [(3)] the patient or [and] the patient's spouse has
2121 [have] a history of infertility of at least three [five] continuous
2222 years' duration or the infertility is associated with:
2323 (A) endometriosis;
2424 (B) exposure in utero to diethylstilbestrol
2525 (DES);
2626 (C) blockage of or surgical removal of one or
2727 both fallopian tubes; or
2828 (D) oligospermia;
2929 (3) [(4)] the patient has been unable to attain a
3030 successful pregnancy through any less costly applicable
3131 infertility treatments for which coverage is available under the
3232 group health benefit plan; and
3333 (4) [(5)] the in vitro fertilization procedures are
3434 performed at a medical facility that conforms to the minimal
3535 standards for programs of in vitro fertilization adopted by the
3636 American Society for Reproductive Medicine.
3737 SECTION 2. Section 1366.005, Insurance Code, as amended by
3838 this Act, applies only to a health benefit plan delivered, issued
3939 for delivery, or renewed on or after January 1, 2024. A health
4040 benefit plan delivered, issued for delivery, or renewed before
4141 January 1, 2024, is governed by the law as it existed immediately
4242 before the effective date of this Act, and that law is continued in
4343 effect for that purpose.
4444 SECTION 3. This Act takes effect September 1, 2023.
