55 relating to crime victims' compensation for criminally injurious
66 conduct in connection with trafficking of persons.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 56B, Code of Criminal
99 Procedure, is amended by adding Article 56B.0035 to read as
1010 follows:
1111 Art. 56B.0035. CRIMINALLY INJURIOUS CONDUCT. (a) For
1212 purposes of this chapter, criminally injurious conduct includes the
1313 solicitation or patronization of forced labor or services,
1414 including sexual conduct, by any person if the solicitation or
1515 patronization occurs in connection with a scheme or course of
1616 conduct that constitutes the trafficking of persons.
1717 (b) A victim of criminally injurious conduct described by
1818 Subsection (a) is a trafficking victim for the purposes of grant
1919 programs administered by the office of the governor.
2020 SECTION 2. The change in law made by this Act applies only
2121 to compensation for criminally injurious conduct occurring on or
2222 after the effective date of this Act. Compensation for criminally
2323 injurious conduct occurring before the effective date of this Act
2424 is governed by the law in effect on the date the conduct occurred,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, criminally injurious conduct occurred
2727 before the effective date of this Act if any element of the offense
2828 underlying the conduct occurred before that date.
2929 SECTION 3. This Act takes effect September 1, 2023.
