| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Title 6, Business & Commerce Code, is amended by |

| 11 | 11 | | adding Chapter 205 to read as follows: |

| 12 | 12 | | CHAPTER 205. REGULATION OF FIREARM TRANSFERS |
|---|
| 13 | 13 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 14 | 14 | | Sec. 205.001. DEFINITION. In this chapter, "firearm" has |
|---|
| 15 | 15 | | the meaning assigned by Section 46.01, Penal Code. |
|---|
| 16 | 16 | | SUBCHAPTER B. NOTICE REQUIRED FOR CERTAIN FIREARM TRANSFERS |
|---|
| 17 | 17 | | Sec. 205.051. NOTICE REQUIRED FOR CERTAIN FIREARM |
|---|
| 18 | 18 | | TRANSFERS; OFFENSE. (a) A person who engages in the retail |
|---|
| 19 | 19 | | business of selling or renting firearms to consumers may not sell, |
|---|
| 20 | 20 | | rent, lease, loan, or give a firearm to another person unless the |
|---|
| 21 | 21 | | person posts the sign described by Subsection (b). |
|---|
| 22 | 22 | | (b) A person described by Subsection (a) shall post, in the |
|---|
| 23 | 23 | | manner described by Subsection (c) at the site or location at which |
|---|
| 24 | 24 | | the firearms are displayed and delivered, a sign that: |
|---|
| 25 | 25 | | (1) includes language that is identical to the |
|---|
| 26 | 26 | | following: "ACCESS TO A FIREARM IN THE HOME SIGNIFICANTLY INCREASES |
|---|
| 27 | 27 | | THE RISK OF SUICIDE, HOMICIDE, DEATH DURING DOMESTIC DISPUTES, AND |
|---|
| 28 | 28 | | UNINTENTIONAL DEATHS OF CHILDREN, HOUSEHOLD MEMBERS, AND OTHERS. |
|---|
| 29 | 29 | | IF YOU OR A LOVED ONE IS EXPERIENCING DISTRESS AND/OR DEPRESSION |
|---|
| 30 | 30 | | CALL THE NATIONAL SUICIDE LIFELINE AT 988."; |
|---|
| 31 | 31 | | (2) includes the language described by Subdivision (1) |
|---|
| 32 | 32 | | in both English and Spanish; |
|---|
| 33 | 33 | | (3) appears in contrasting colors with block letters |
|---|
| 34 | 34 | | in at least 24-point font; |
|---|
| 35 | 35 | | (4) is 8.5 by 11 inches or larger; and |
|---|
| 36 | 36 | | (5) is displayed in a conspicuous manner clearly |
|---|
| 37 | 37 | | visible to the public. |
|---|
| 38 | 38 | | (c) A sign described by Subsection (b) must be posted at |
|---|
| 39 | 39 | | each entrance to the site or location and near the point of sale. |
|---|
| 40 | 40 | | (d) A person who violates this section commits an offense. |
|---|
| 41 | 41 | | An offense under this section is a Class C misdemeanor. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect September 1, 2023. |
