77 relating to a required notice for certain firearm transfers;
88 creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 6, Business & Commerce Code, is amended by
1111 adding Chapter 205 to read as follows:
1212 CHAPTER 205. REGULATION OF FIREARM TRANSFERS
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 205.001. DEFINITION. In this chapter, "firearm" has
1515 the meaning assigned by Section 46.01, Penal Code.
1616 SUBCHAPTER B. NOTICE REQUIRED FOR CERTAIN FIREARM TRANSFERS
1717 Sec. 205.051. NOTICE REQUIRED FOR CERTAIN FIREARM
1818 TRANSFERS; OFFENSE. (a) A person who engages in the retail
1919 business of selling or renting firearms to consumers may not sell,
2020 rent, lease, loan, or give a firearm to another person unless the
2121 person posts the sign described by Subsection (b).
2222 (b) A person described by Subsection (a) shall post, in the
2323 manner described by Subsection (c) at the site or location at which
2424 the firearms are displayed and delivered, a sign that:
2525 (1) includes language that is identical to the
2626 following: "ACCESS TO A FIREARM IN THE HOME SIGNIFICANTLY INCREASES
2727 THE RISK OF SUICIDE, HOMICIDE, DEATH DURING DOMESTIC DISPUTES, AND
2828 UNINTENTIONAL DEATHS OF CHILDREN, HOUSEHOLD MEMBERS, AND OTHERS.
2929 IF YOU OR A LOVED ONE IS EXPERIENCING DISTRESS AND/OR DEPRESSION
3030 CALL THE NATIONAL SUICIDE LIFELINE AT 988.";
3131 (2) includes the language described by Subdivision (1)
3232 in both English and Spanish;
3333 (3) appears in contrasting colors with block letters
3434 in at least 24-point font;
3535 (4) is 8.5 by 11 inches or larger; and
3636 (5) is displayed in a conspicuous manner clearly
3737 visible to the public.
3838 (c) A sign described by Subsection (b) must be posted at
3939 each entrance to the site or location and near the point of sale.
4040 (d) A person who violates this section commits an offense.
4141 An offense under this section is a Class C misdemeanor.
4242 SECTION 2. This Act takes effect September 1, 2023.
