55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to repealing the affirmative defense to prosecution for
88 the criminal offense of sale, distribution, or display of harmful
99 material to a minor.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.24(c), Penal Code, is repealed.
1212 SECTION 2. The change in law made by this Act applies only
1313 to an offense committed on or after the effective date of this Act.
1414 An offense committed before the effective date of this Act is
1515 governed by the law in effect on the date the offense was committed,
1616 and the former law is continued in effect for that purpose. For
1717 purposes of this section, an offense was committed before the
1818 effective date of this Act if any element of the offense occurred
1919 before that date.
2020 SECTION 3. This Act takes effect September 1, 2023.
