55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the determination of resident status of students by
88 public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.052, Education Code, is amended to
1111 read as follows:
1212 Sec. 54.052. DETERMINATION OF RESIDENT STATUS. (a)
1313 Subject to the other applicable provisions of this subchapter
1414 governing the determination of resident status, the following
1515 persons are considered residents of this state for purposes of this
1616 title:
1717 (1) a person who:
1818 (A) established a domicile in this state not
1919 later than one year before the census date of the academic term in
2020 which the person is enrolled in an institution of higher education;
2121 and
2222 (B) maintained that domicile continuously for
2323 the year preceding that census date; and
2424 (2) a dependent whose parent:
2525 (A) established a domicile in this state not
2626 later than one year before the census date of the academic term in
2727 which the dependent is enrolled in an institution of higher
2828 education; and
2929 (B) maintained that domicile continuously for
3030 the year preceding that census date[; and
3131 [(3) a person who:
3232 [(A) graduated from a public or private high
3333 school in this state or received the equivalent of a high school
3434 diploma in this state; and
3535 [(B) maintained a residence continuously in this
3636 state for:
3737 [(i) the three years preceding the date of
3838 graduation or receipt of the diploma equivalent, as applicable; and
3939 [(ii) the year preceding the census date of
4040 the academic term in which the person is enrolled in an institution
4141 of higher education].
4242 (b) For purposes of this section, the domicile of a
4343 dependent's parent is presumed to be the domicile of the dependent
4444 [unless the person establishes eligibility for resident status
4545 under Subsection (a)(3)].
4646 (c) A person who is not authorized under federal statute to
4747 be present in the United States may not be considered a resident of
4848 this state for purposes of this title.
4949 SECTION 2. Section 54.053, Education Code, is amended to
5050 read as follows:
5151 Sec. 54.053. INFORMATION REQUIRED TO ESTABLISH RESIDENT
5252 STATUS. A person shall submit the following information to an
5353 institution of higher education to establish resident status under
5454 this subchapter:
5555 (1) if the person applies for resident status under
5656 Section 54.052(a)(1):
5757 (A) a statement of the dates and length of time
5858 the person has resided in this state, as relevant to establish
5959 resident status under this subchapter; and
6060 (B) a statement by the person that the person's
6161 presence in this state for that period was for a purpose of
6262 establishing and maintaining a domicile; or
6363 (2) if the person applies for resident status under
6464 Section 54.052(a)(2):
6565 (A) a statement of the dates and length of time
6666 any parent of the person has resided in this state, as relevant to
6767 establish resident status under this subchapter; and
6868 (B) a statement by the parent or, if the parent is
6969 unable or unwilling to provide the statement, a statement by the
7070 person that the parent's presence in this state for that period was
7171 for a purpose of establishing and maintaining a domicile[; or
7272 [(3) if the person applies for resident status under
7373 Section 54.052(a)(3):
7474 [(A) a statement of the dates and length of time
7575 the person has resided in this state, as relevant to establish
7676 resident status under this subchapter; and
7777 [(B) if the person is not a citizen or permanent
7878 resident of the United States, an affidavit stating that the person
7979 will apply to become a permanent resident of the United States as
8080 soon as the person becomes eligible to apply].
8181 SECTION 3. Notwithstanding Subchapter B, Chapter 54,
8282 Education Code, a public institution of higher education in this
8383 state may, for any semester or academic term, before the beginning
8484 of that semester or academic term, reclassify as a nonresident a
8585 student previously classified as a resident of this state by the
8686 institution or another public institution of higher education in
8787 this state:
8888 (1) under Section 54.052(a)(3), Education Code, as
8989 that section existed before amendment by this Act, if the student is
9090 not otherwise eligible to be classified as a resident of this state
9191 under Subchapter B, Chapter 54, Education Code; or
9292 (2) before the enactment of Section 54.052(c),
9393 Education Code, as added by this Act, if the student is not
9494 authorized under federal statute to be present in the United
9595 States.
9696 SECTION 4. This Act takes effect September 1, 2023.
