| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 431, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 431.143 to read as follows: |
|---|
| 12 | 12 | | Sec. 431.143. MANUFACTURER DISCLOSURES: LIPSTICK AND LIP |
|---|
| 13 | 13 | | GLOSS COSMETIC. The executive commissioner by rule shall require a |
|---|
| 14 | 14 | | manufacturer that sells a lipstick or lip gloss cosmetic to |
|---|
| 15 | 15 | | disclose on the manufacturer's Internet website and the cosmetic |
|---|
| 16 | 16 | | label: |
|---|
| 17 | 17 | | (1) any toxic metal, including lead, chromium, |
|---|
| 18 | 18 | | cadmium, aluminum, and manganese, in the cosmetic, regardless of |
|---|
| 19 | 19 | | whether the concentration of the metal in the cosmetic is less than |
|---|
| 20 | 20 | | one percent; and |
|---|
| 21 | 21 | | (2) a list of each ingredient in the cosmetic, |
|---|
| 22 | 22 | | including a fragrance, flavor, and color additive. |

| 23 | 23 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 24 | 24 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 25 | 25 | | Services Commission shall adopt rules necessary to implement |
|---|
| 26 | 26 | | Section 431.143, Health and Safety Code, as added by this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2023. |
