66 AN ACT
77 relating to a manufacturer's disclosure of ingredients and toxic
88 metals in lipstick and lip gloss.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 431, Health and Safety
1111 Code, is amended by adding Section 431.143 to read as follows:
1212 Sec. 431.143. MANUFACTURER DISCLOSURES: LIPSTICK AND LIP
1313 GLOSS COSMETIC. The executive commissioner by rule shall require a
1414 manufacturer that sells a lipstick or lip gloss cosmetic to
1515 disclose on the manufacturer's Internet website and the cosmetic
1616 label:
1717 (1) any toxic metal, including lead, chromium,
1818 cadmium, aluminum, and manganese, in the cosmetic, regardless of
1919 whether the concentration of the metal in the cosmetic is less than
2020 one percent; and
2121 (2) a list of each ingredient in the cosmetic,
2222 including a fragrance, flavor, and color additive.
2323 SECTION 2. As soon as practicable after the effective date
2424 of this Act, the executive commissioner of the Health and Human
2525 Services Commission shall adopt rules necessary to implement
2626 Section 431.143, Health and Safety Code, as added by this Act.
2727 SECTION 3. This Act takes effect September 1, 2023.
