A BILL TO BE ENTITLED
AN ACT
relating to the purchase of a United States flag or Texas flag by a
governmental agency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 2158, Government Code, is amended by
adding Subchapter I to read as follows:
SUBCHAPTER I. PURCHASE OF UNITED STATES FLAG OR STATE FLAG
Sec. 2158.501. FLAG PROCUREMENT BY STATE AGENCY. (a) In
this subchapter, "state agency" means:
(1) a department, commission, board, office, or other
agency in the executive branch created by the constitution or a
statute of this state;
(2) the supreme court, the court of criminal appeals,
a court of appeals, or the Texas Judicial Council; or
(3) a university system or an institution of higher
education as defined by Section 61.003, Education Code.
(b) For each United States flag or Texas state flag
purchased by a state agency, the agency must:
(1) give first preference to flags manufactured in
this state using materials grown, produced, or manufactured in this
state to the extent reasonable and practicable; and
(2) give second preference to flags manufactured in
this state or the United States using materials grown, produced, or
manufactured in the United States.
SECTION 2. Subchapter Z, Chapter 271, Local Government
Code, is amended by adding Section 271.909 to read as follows:
Sec. 271.909. FLAG PROCUREMENT BY GOVERNMENTAL AGENCY. (a)
In this section, "governmental agency" has the meaning assigned by
Section 271.003.
(b) For each United States flag or Texas state flag
purchased by a governmental agency, the agency must:
(1) give first preference to flags manufactured in
this state using materials grown, produced, or manufactured in this
state to the extent reasonable and practicable; and
(2) give second preference to flags manufactured in
this state or the United States using materials grown, produced, or
manufactured in the United States.
SECTION 3. Section 2158.501, Government Code, and Section
271.909, Local Government Code, as added by this Act, apply only to
the purchase of a United States flag or Texas flag made or a
contract for the purchase of a United States flag or Texas flag
entered into on or after the effective date of this Act.
SECTION 4. This Act takes effect September 1, 2023.
