55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the qualifications required to hold the office of
88 constable in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 86.0021, Local Government Code, is
1111 amended by amending Subsection (a) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) A person is not eligible to serve as constable in a
1414 county with a population of less than 200,000 unless:
1515 (1) the person is eligible to be licensed under
1616 Sections 1701.309 and 1701.312, Occupations Code, and:
1717 (A) has at least an associate's degree conferred
1818 by an institution of higher education accredited by an accrediting
1919 organization recognized by the Texas Higher Education Coordinating
2020 Board;
2121 (B) is a special investigator under Article
2222 2.122(a), Code of Criminal Procedure; or
2323 (C) is an honorably retired peace officer or
2424 honorably retired federal criminal investigator who holds a
2525 certificate of proficiency issued under Section 1701.357,
2626 Occupations Code; or
2727 (2) the person is an active or inactive licensed peace
2828 officer under Chapter 1701, Occupations Code.
2929 (a-1) A person is not eligible to serve as constable in a
3030 county with a population of 200,000 or more unless:
3131 (1) the person is eligible to be licensed under
3232 Sections 1701.309 and 1701.312, Occupations Code, and:
3333 (A) is a special investigator under Article
3434 2.122(a), Code of Criminal Procedure; or
3535 (B) is an honorably retired peace officer or
3636 honorably retired federal criminal investigator who holds a
3737 certificate of proficiency issued under Section 1701.357,
3838 Occupations Code; or
3939 (2) the person is an active or inactive licensed peace
4040 officer under Chapter 1701, Occupations Code.
4141 SECTION 2. The change in law made by this Act applies only
4242 to a constable elected or appointed to serve a term of office that
4343 begins on or after the effective date of this Act. A constable
4444 serving a term of office that began before the effective date of
4545 this Act is governed for the remainder of that term by the
4646 applicable law that existed immediately before the effective date
4747 of this Act, and the former law is continued in effect for that
4848 purpose.
4949 SECTION 3. This Act takes effect September 1, 2023.
