5	5	AN ACT
6	6	relating to responsibility for law enforcement and security
7	7	services within the Capitol Complex.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. This Act may be cited as the Texas Capitol Public
10	10	Safety Protection Act.
11	11	SECTION 2. Section 411.061(a), Government Code, is amended
12	12	to read as follows:
13	13	(a) In this subchapter, "Capitol Complex" means:the
14	14	fo11owing property that is 1ocatcd in Austin, Texas, to the extent
15	15	the property is owned by or under the control of the state:
16	16	(1) all property, public and private, that is located
17	17	within the corporate boundaries of Austin, Texas; and
18	18	(2) other locations under the jurisdiction of the
19	19	capitol police district as may be approved by the director.
20	20	(1) the area bounded on the north by the inside curb of
21	21	Martin Luther King, Jr., Boulevard, on the east by the outside curb
22	22	of Trinity Street, on the south by the outside curb of 10th Street,
23	23	and on the west by the outside curb of Lavaca Street;
24	24	(2) the William P. Clements State Office Building located at
25	25	300 West 15th Street; and
26	26	(3) other locations under the jurisdiction of the capitol
27	27	police district as may be approved by the director.
28	28	SECTION 3. Section 411.062(a), Government Code, is amended
29	29	to read as follows:
30	30	(a) The department has primary responsibility for law
31	31	enforcement and security services within the boundaries ofon the
32	32	Capitol Complex.
33	33	SECTION 4. Section 411.062(d-1), Government Code, is
34	34	amended to read as follows:
35	35	(d-1) The director shall adopt rules governing the use of
36	36	unmanned aircraft in the Capitol Complex. The rules adopted under
37	37	this subsection may:
38	38	(1) prohibit the use of unmanned aircraft in
39	39	designated areas of the Capitol Complex; or
40	40	(2) authorize limited use of unmanned aircraft in
41	41	designated areas of the Capitol Complex.
42	42	SECTION 5. Section 411.062(f), Government Code, is amended
43	43	by amending subsection (f) and adding subsection (f-1) to read as
44	44	follows:
45	45	(f) Not later than 90 days after the effective date of this
46	46	Act, tThe department and the City of Austin shall execute an
47	47	interlocal cooperation agreement that defines the respective
48	48	responsibilities of the department and the city for traffic and
49	49	parking enforcement, public safety, and general law enforcement
50	50	security in the Capitol Complex, including private property within
51	51	the boundaries of the complex. The city shall exercise
52	52	responsibilities designated to it by the agreement under the
53	53	authority and supervision of the department.
54	54	(f-1) The interlocal cooperation agreement must include a
55	55	formula for calculating the annual cost of law enforcement and
56	56	public safety services provided by the department to the city.
57	57	Within 30 business days of the conclusion of the state fiscal year,
58	58	the department shall notify the comptroller of the cost of law
59	59	enforcement and public safety services provided by the department
60	60	to the city for that fiscal year. The comptroller shall deduct the
61	61	amount reported to the comptroller from the city's share of taxes
62	62	collected by the comptroller under Chapter 321, Tax Code, and
63	63	credit that deducted amount to the state general revenue fund.
64	64	SECTION 6. Subchapter F, Chapter 321, Tax Code, is amended
65	65	by adding Section 321.511 to read as follows:
66	66	Sec. 321.511. DEDUCTION OF TRUST FUNDS FOR PUBLIC SAFETY
67	67	AND LAW ENFORCEMENT WITHIN THE CAPITOL COMPLEX. (a) In this section
68	68	"Capitol Complex" has the meaning assigned by Section 411.061(a),
69	69	Government Code.
70	70	(b) Notwithstanding Section 321.502, upon receipt of
71	71	notification from the Department of Public Safety of the cost of
72	72	public safety and law enforcement services rendered by the
73	73	department to the City of Austin under Chapter 411, Subchapter E,
74	74	Government Code, the comptroller shall deduct the amount reported
75	75	from the city's share of the taxes collected by the comptroller
76	76	under this subchapter during the state fiscal year and credit that
77	77	deducted amount to the state general revenue fund. Money credited
78	78	to the general revenue fund under this subsection may be
79	79	appropriated only to the Department of Public Safety.
80	80	SECTION 7. This Act takes effect immediately if it receives
81	81	a vote of two-thirds of all the members elected to each house, as
82	82	provided by Section 39, Article III, Texas Constitution. If this
83	83	Act does not receive the vote necessary for immediate effect, this
84	84	Act takes effect September 1, 2023.
