55 AN ACT
66 relating to responsibility for law enforcement and security
77 services within the Capitol Complex.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act may be cited as the Texas Capitol Public
1010 Safety Protection Act.
1111 SECTION 2. Section 411.061(a), Government Code, is amended
1212 to read as follows:
1313 (a) In this subchapter, "Capitol Complex" means:the
1414 fo11owing property that is 1ocatcd in Austin, Texas, to the extent
1515 the property is owned by or under the control of the state:
1616 (1) all property, public and private, that is located
1717 within the corporate boundaries of Austin, Texas; and
1818 (2) other locations under the jurisdiction of the
1919 capitol police district as may be approved by the director.
2020 (1) the area bounded on the north by the inside curb of
2121 Martin Luther King, Jr., Boulevard, on the east by the outside curb
2222 of Trinity Street, on the south by the outside curb of 10th Street,
2323 and on the west by the outside curb of Lavaca Street;
2424 (2) the William P. Clements State Office Building located at
2525 300 West 15th Street; and
2626 (3) other locations under the jurisdiction of the capitol
2727 police district as may be approved by the director.
2828 SECTION 3. Section 411.062(a), Government Code, is amended
2929 to read as follows:
3030 (a) The department has primary responsibility for law
3131 enforcement and security services within the boundaries ofon the
3232 Capitol Complex.
3333 SECTION 4. Section 411.062(d-1), Government Code, is
3434 amended to read as follows:
3535 (d-1) The director shall adopt rules governing the use of
3636 unmanned aircraft in the Capitol Complex. The rules adopted under
3737 this subsection may:
3838 (1) prohibit the use of unmanned aircraft in
3939 designated areas of the Capitol Complex; or
4040 (2) authorize limited use of unmanned aircraft in
4141 designated areas of the Capitol Complex.
4242 SECTION 5. Section 411.062(f), Government Code, is amended
4343 by amending subsection (f) and adding subsection (f-1) to read as
4444 follows:
4545 (f) Not later than 90 days after the effective date of this
4646 Act, tThe department and the City of Austin shall execute an
4747 interlocal cooperation agreement that defines the respective
4848 responsibilities of the department and the city for traffic and
4949 parking enforcement, public safety, and general law enforcement
5050 security in the Capitol Complex, including private property within
5151 the boundaries of the complex. The city shall exercise
5252 responsibilities designated to it by the agreement under the
5353 authority and supervision of the department.
5454 (f-1) The interlocal cooperation agreement must include a
5555 formula for calculating the annual cost of law enforcement and
5656 public safety services provided by the department to the city.
5757 Within 30 business days of the conclusion of the state fiscal year,
5858 the department shall notify the comptroller of the cost of law
5959 enforcement and public safety services provided by the department
6060 to the city for that fiscal year. The comptroller shall deduct the
6161 amount reported to the comptroller from the city's share of taxes
6262 collected by the comptroller under Chapter 321, Tax Code, and
6363 credit that deducted amount to the state general revenue fund.
6464 SECTION 6. Subchapter F, Chapter 321, Tax Code, is amended
6565 by adding Section 321.511 to read as follows:
6666 Sec. 321.511. DEDUCTION OF TRUST FUNDS FOR PUBLIC SAFETY
6767 AND LAW ENFORCEMENT WITHIN THE CAPITOL COMPLEX. (a) In this section
6868 "Capitol Complex" has the meaning assigned by Section 411.061(a),
6969 Government Code.
7070 (b) Notwithstanding Section 321.502, upon receipt of
7171 notification from the Department of Public Safety of the cost of
7272 public safety and law enforcement services rendered by the
7373 department to the City of Austin under Chapter 411, Subchapter E,
7474 Government Code, the comptroller shall deduct the amount reported
7575 from the city's share of the taxes collected by the comptroller
7676 under this subchapter during the state fiscal year and credit that
7777 deducted amount to the state general revenue fund. Money credited
7878 to the general revenue fund under this subsection may be
7979 appropriated only to the Department of Public Safety.
8080 SECTION 7. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2023.
