11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Article 2.122, Code of Criminal Procedure, is |
---|
13 | 13 | | amended by adding Subsection (c-1) to read as follows: |
---|
14 | 14 | | (c-1) In addition to the power granted under Subsection (c), |
---|
15 | 15 | | a Border Patrol Agent of the United States Customs and Border |
---|
16 | 16 | | Protection has the powers of arrest and search and seizure as to any |
---|
17 | 17 | | felony offense under the laws of this state, or any criminal offense |
---|
18 | 18 | | under federal law, committed within the boundaries of a county: |
---|
19 | 19 | | (1) adjacent to the Texas-Mexico border or the Gulf of |
---|
20 | 20 | | Mexico; |
---|
21 | 21 | | (2) adjacent to a county described by Subdivision (1); |
---|
22 | 22 | | or |
---|
23 | 23 | | (3) served by an attorney representing the state whose |
---|
24 | 24 | | jurisdiction includes a county described by Subdivision (1) or (2). |
---|
25 | 25 | | SECTION 2. As soon as practicable after the effective date |
---|
26 | 26 | | of this Act, the office of the attorney general shall give written |
---|
27 | 27 | | notice to the commanding authority of each United States border |
---|
28 | 28 | | patrol sector in this state regarding the authority granted to |
---|
29 | 29 | | border patrol agents by this Act and the counties in that sector in |
---|
30 | 30 | | which this authority may be exercised. |
---|
31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
---|
32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
---|
33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
---|
35 | 35 | | Act takes effect September 1, 2023. |
