66 AN ACT
77 relating to the manufacture of a firearm without a federal license;
88 creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 46, Penal Code, is amended by adding
1111 Section 46.051 to read as follows:
1212 Sec. 46.051. MANUFACTURE OF FIREARM WITHOUT FEDERAL LICENSE
1313 PROHIBITED. (a) A person who does not hold a federal license to
1414 manufacture firearms under 18 U.S.C. Section 923 commits an offense
1515 if the person intentionally or knowingly manufactures a firearm.
1616 (b) An offense under this section is a Class A misdemeanor.
1717 (c) If conduct that constitutes an offense under this
1818 section also constitutes an offense under any other law, the actor
1919 may be prosecuted under this section, the other law, or both.
2020 SECTION 2. This Act takes effect September 1, 2023.
