| 7 | 7 | | relating to the operation of a quick draw lottery game; requiring an |

| 8 | 8 | | occupational license. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 466.002, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subdivision (8-a) to read as follows: |
|---|
| 12 | 12 | | (8-a) "Quick draw lottery game" means a lottery game |
|---|
| 13 | 13 | | in which a drawing to select the winning ticket occurs 12 to 15 |
|---|
| 14 | 14 | | times per hour between the hours of 7 a.m. and 2 a.m. of the |
|---|
| 15 | 15 | | following day. |
|---|
| 16 | 16 | | SECTION 2. Subchapter B, Chapter 466, Government Code, is |
|---|
| 17 | 17 | | amended by adding Section 466.0275 to read as follows: |
|---|
| 18 | 18 | | Sec. 466.0275. QUICK DRAW LOTTERY GAME; SALES AGENT LICENSE |
|---|
| 19 | 19 | | FOR QUICK DRAW LOTTERY GAME. (a) The commission shall operate a |
|---|
| 20 | 20 | | quick draw lottery game. The commission shall: |
|---|
| 21 | 21 | | (1) determine the ticket price, payout amounts, and |
|---|
| 22 | 22 | | manner in which the game is conducted; |
|---|
| 23 | 23 | | (2) restrict the locations authorized to sell the |
|---|
| 24 | 24 | | quick draw lottery game tickets to only locations licensed as sales |
|---|
| 25 | 25 | | agents in accordance with Subsection (b); and |
|---|
| 26 | 26 | | (3) ensure the game remains competitive with other |
|---|
| 27 | 27 | | lottery games the commission offers. |
|---|
| 28 | 28 | | (b) The commission may license as sales agents to sell quick |
|---|
| 29 | 29 | | draw lottery game tickets only holders of one of the following |
|---|
| 30 | 30 | | permits or licenses issued by the Texas Alcoholic Beverage |
|---|
| 31 | 31 | | Commission for locations that provide on-premises consumption of |
|---|
| 32 | 32 | | alcohol: |
|---|
| 33 | 33 | | (1) a winery permit; |
|---|
| 34 | 34 | | (2) a wine and malt beverage retailer's permit; |
|---|
| 35 | 35 | | (3) a mixed beverage permit; |
|---|
| 36 | 36 | | (4) a private club registration permit; |
|---|
| 37 | 37 | | (5) a retail dealer's on-premise license; |
|---|
| 38 | 38 | | (6) a brewpub license; |
|---|
| 39 | 39 | | (7) a brewer's license; or |
|---|
| 40 | 40 | | (8) a distiller's and rectifier's permit. |
|---|
| 41 | 41 | | (c) Section 466.155(a)(4)(C) does not apply to a sales agent |
|---|
| 42 | 42 | | who is licensed to sell quick draw lottery game tickets. |
|---|
| 43 | 43 | | (d) The commission shall market and advertise the lottery |
|---|
| 44 | 44 | | game operated under this section in a manner intended to inform the |
|---|
| 45 | 45 | | public that the game tickets are available for purchase from |
|---|
| 46 | 46 | | licensed sales agents described by Subsection (b). |
|---|
| 47 | 47 | | (e) The commission shall adopt the rules necessary to |
|---|
| 48 | 48 | | operate a quick draw lottery game. |
|---|
| 49 | 49 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 50 | 50 | | of this Act but not later than January 1, 2024, the Texas Lottery |
|---|
| 51 | 51 | | Commission shall implement Section 466.0275, Government Code, as |
|---|
| 52 | 52 | | added by this Act, by adopting all necessary rules and procedures, |
|---|
| 53 | 53 | | issuing sales agent licenses, and establishing the quick draw |
|---|
| 54 | 54 | | lottery game. |
|---|
| 55 | 55 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 56 | 56 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 57 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 58 | 58 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 59 | 59 | | Act takes effect September 1, 2023. |
