| 7 | 7 | | relating to the provision of information regarding mental health |

| 8 | 8 | | and suicide prevention services to entering students at public |
|---|
| 9 | 9 | | institutions of higher education. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 51.9194, Education Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (a) An institution of higher education [A general academic |
|---|
| 15 | 15 | | teaching institution] shall provide to each entering [full-time] |
|---|
| 16 | 16 | | undergraduate, graduate, or professional student, including each |
|---|
| 17 | 17 | | [full-time] undergraduate, graduate, or professional student who |
|---|
| 18 | 18 | | transfers to the institution, information about: |
|---|
| 19 | 19 | | (1) available mental health and suicide prevention |
|---|
| 20 | 20 | | services offered by the institution or by any associated |
|---|
| 21 | 21 | | organizations or programs; and |
|---|
| 22 | 22 | | (2) early warning signs that are often present in and |
|---|
| 23 | 23 | | appropriate intervention for a person who may be considering |
|---|
| 24 | 24 | | suicide. |
|---|
| 25 | 25 | | (a-1) In this section, "institution of higher education" |
|---|
| 26 | 26 | | has the meaning assigned by Section 61.003. |
|---|
| 27 | 27 | | SECTION 2. Section 51.9194, Education Code, as amended by |
|---|
| 28 | 28 | | this Act, applies beginning with the 2023-2024 academic year. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
