5	5	relating to a requirement that employers post notice of certain
6	6	information regarding reporting instances of workplace violence or
7	7	suspicious activity.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Title 3, Labor Code, is amended by adding Chapter
10	10	104A to read as follows:
11	11	CHAPTER 104A. REPORTING WORKPLACE VIOLENCE
12	12	Sec. 104A.001. DEFINITIONS. In this chapter:
13	13	(1) "Commission" means the Texas Workforce
14	14	Commission.
15	15	(2) "Employee" means an individual who is employed by
16	16	an employer for compensation.
17	17	(3) "Employer" means a person who employs one or more
18	18	employees.
19	19	Sec. 104A.002. NOTICE BY EMPLOYER. Each employer shall
20	20	post a notice to employees of the contact information for reporting
21	21	instances of workplace violence or suspicious activity to the
22	22	Department of Public Safety. The notice must be posted:
23	23	(1) in a conspicuous place in the employer's place of
24	24	business;
25	25	(2) in sufficient locations to be convenient to all
26	26	employees; and
27	27	(3) in English and Spanish, as appropriate.
28	28	Sec. 104A.003. RULES. The commission, in consultation with
29	29	the Department of Public Safety, by rule shall prescribe the form
30	30	and content of the notice required by this section. The rules must
31	31	require that the notice:
32	32	(1) contain the contact information for reporting
33	33	instances of workplace violence or suspicious activity to the
34	34	Department of Public Safety; and
35	35	(2) inform employees of the right to make a report to
36	36	the Department of Public Safety anonymously.
37	37	SECTION 2. Not later than March 1, 2024, the Texas Workforce
38	38	Commission shall adopt rules as required by Section 104A.003, Labor
39	39	Code, as added by this Act.
40	40	SECTION 3. This Act takes effect September 1, 2023.
