77 suspicious activity.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 3, Labor Code, is amended by adding Chapter
1010 104A to read as follows:
1111 CHAPTER 104A. REPORTING WORKPLACE VIOLENCE
1212 Sec. 104A.001. DEFINITIONS. In this chapter:
1313 (1) "Commission" means the Texas Workforce
1414 Commission.
1515 (2) "Employee" means an individual who is employed by
1616 an employer for compensation.
1717 (3) "Employer" means a person who employs one or more
1818 employees.
1919 Sec. 104A.002. NOTICE BY EMPLOYER. Each employer shall
2020 post a notice to employees of the contact information for reporting
2121 instances of workplace violence or suspicious activity to the
2222 Department of Public Safety. The notice must be posted:
2323 (1) in a conspicuous place in the employer's place of
2424 business;
2525 (2) in sufficient locations to be convenient to all
2626 employees; and
2727 (3) in English and Spanish, as appropriate.
2828 Sec. 104A.003. RULES. The commission, in consultation with
2929 the Department of Public Safety, by rule shall prescribe the form
3030 and content of the notice required by this section. The rules must
3131 require that the notice:
3232 (1) contain the contact information for reporting
3333 instances of workplace violence or suspicious activity to the
3434 Department of Public Safety; and
3535 (2) inform employees of the right to make a report to
3636 the Department of Public Safety anonymously.
3737 SECTION 2. Not later than March 1, 2024, the Texas Workforce
3838 Commission shall adopt rules as required by Section 104A.003, Labor
3939 Code, as added by this Act.
4040 SECTION 3. This Act takes effect September 1, 2023.
