10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter C, Chapter 48, Education Code, is |
---|
12 | 12 | | amended by adding Section 48.116 to read as follows: |

13 | 13 | | Sec. 48.116. ALLOTMENT FOR STUDENTS WITH INCARCERATED |
---|
14 | 14 | | PARENT. For each student who has a parent or legal guardian who has |
---|
15 | 15 | | been incarcerated in a penal institution, as defined by Section |
---|
16 | 16 | | 1.07, Penal Code, during the school year for which the allotment is |
---|
17 | 17 | | provided, a school district is entitled to an annual allotment |
---|
18 | 18 | | equal to the district's basic allotment, or, if applicable, the sum |
---|
19 | 19 | | of the basic allotment and the allotment under Section 48.101 to |
---|
20 | 20 | | which the district is entitled, multiplied by 1.1. |
---|
21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
