55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the permissible uses of the compensatory education
88 allotment under the Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.104, Education Code, is amended by
1111 amending Subsections (k) and (l) and adding Subsection (k-1) to
1212 read as follows:
1313 (k) Subject to Subsection (k-1), at [At] least 55 percent of
1414 the funds allocated under this section must be used to:
1515 (1) fund supplemental programs and services,
1616 including services provided by an instructional coach, designed to
1717 eliminate any disparity in performance on assessment instruments
1818 administered under Subchapter B, Chapter 39, or disparity in the
1919 rates of high school completion between:
2020 (A) students who are educationally disadvantaged
2121 and students who are not educationally disadvantaged; and
2222 (B) students at risk of dropping out of school,
2323 as defined by Section 29.081, and all other students; or
2424 (2) support a program eligible under Title I of the
2525 Elementary and Secondary Education Act of 1965, as provided by Pub.
2626 L. No. 103-382 and its subsequent amendments, and by federal
2727 regulations implementing that Act.
2828 (k-1) A school district may not use more than 40 percent of
2929 the funds allocated to the district under this section to pay for:
3030 (1) teacher salaries;
3131 (2) supplemental staff expenses;
3232 (3) additional staff; or
3333 (4) smaller class size.
3434 (l) The commissioner shall adopt rules regarding the use of
3535 funds allocated under this section as provided [described] by
3636 Subsections [Subsection] (k) and (k-1). The rules:
3737 (1) must:
3838 (A) permit a school district to use those funds
3939 for programs and services that reflect the needs of students at each
4040 campus in the district; and
4141 (B) provide for streamlined reporting on the use
4242 of those funds; and
4343 (2) may not prohibit the use of those funds for any
4444 purpose for which the use of those funds was authorized under former
4545 Section 42.152 as that section existed on September 1, 2018.
4646 SECTION 2. This Act takes effect September 1, 2023.
