| 7 | 7 | | relating to the permissible uses of the compensatory education |

| 8 | 8 | | allotment under the Foundation School Program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 48.104, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsections (k) and (l) and adding Subsection (k-1) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (k) Subject to Subsection (k-1), at [At] least 55 percent of |
|---|
| 14 | 14 | | the funds allocated under this section must be used to: |
|---|
| 15 | 15 | | (1) fund supplemental programs and services, |
|---|
| 16 | 16 | | including services provided by an instructional coach, designed to |
|---|
| 17 | 17 | | eliminate any disparity in performance on assessment instruments |
|---|
| 18 | 18 | | administered under Subchapter B, Chapter 39, or disparity in the |
|---|
| 19 | 19 | | rates of high school completion between: |
|---|
| 20 | 20 | | (A) students who are educationally disadvantaged |
|---|
| 21 | 21 | | and students who are not educationally disadvantaged; and |
|---|
| 22 | 22 | | (B) students at risk of dropping out of school, |
|---|
| 23 | 23 | | as defined by Section 29.081, and all other students; or |
|---|
| 24 | 24 | | (2) support a program eligible under Title I of the |
|---|
| 25 | 25 | | Elementary and Secondary Education Act of 1965, as provided by Pub. |
|---|
| 26 | 26 | | L. No. 103-382 and its subsequent amendments, and by federal |
|---|
| 27 | 27 | | regulations implementing that Act. |
|---|
| 28 | 28 | | (k-1) A school district may not use more than 40 percent of |
|---|
| 29 | 29 | | the funds allocated to the district under this section to pay for: |
|---|
| 30 | 30 | | (1) teacher salaries; |
|---|
| 31 | 31 | | (2) supplemental staff expenses; |
|---|
| 32 | 32 | | (3) additional staff; or |
|---|
| 33 | 33 | | (4) smaller class size. |
|---|
| 34 | 34 | | (l) The commissioner shall adopt rules regarding the use of |
|---|
| 35 | 35 | | funds allocated under this section as provided [described] by |
|---|
| 36 | 36 | | Subsections [Subsection] (k) and (k-1). The rules: |
|---|
| 37 | 37 | | (1) must: |
|---|
| 38 | 38 | | (A) permit a school district to use those funds |
|---|
| 39 | 39 | | for programs and services that reflect the needs of students at each |
|---|
| 40 | 40 | | campus in the district; and |
|---|
| 41 | 41 | | (B) provide for streamlined reporting on the use |
|---|
| 42 | 42 | | of those funds; and |
|---|
| 43 | 43 | | (2) may not prohibit the use of those funds for any |
|---|
| 44 | 44 | | purpose for which the use of those funds was authorized under former |
|---|
| 45 | 45 | | Section 42.152 as that section existed on September 1, 2018. |
|---|
| 46 | 46 | | SECTION 2. This Act takes effect September 1, 2023. |
