| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 361, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 361.042 to read as follows: |

| 12 | 12 | | Sec. 361.042. MINIMUM CARCINOGENIC RISK LEVEL. (a) In this |
|---|
| 13 | 13 | | section, "carcinogenic risk level," "protective concentration |
|---|
| 14 | 14 | | level," and "risk-based exposure limit" have the meanings assigned |
|---|
| 15 | 15 | | by 30 T.A.C. Section 350.4, as that section existed on January 1, |
|---|
| 16 | 16 | | 2023. |
|---|
| 17 | 17 | | (b) The commission shall set each carcinogenic risk level |
|---|
| 18 | 18 | | used by the commission in the development of a protective |
|---|
| 19 | 19 | | concentration level, risk-based exposure limit, or any other |
|---|
| 20 | 20 | | remediation standard used in connection with this chapter or a rule |
|---|
| 21 | 21 | | adopted under this chapter, including the Texas Risk Reduction |
|---|
| 22 | 22 | | Program (30 T.A.C. Chapter 350) or a similar program established by |
|---|
| 23 | 23 | | the commission, at a rate not greater than one in one million. |

| 24 | 24 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 25 | 25 | | of this Act, the Texas Commission on Environmental Quality shall |
|---|
| 26 | 26 | | adopt or modify any rules necessary to implement the change in law |
|---|
| 27 | 27 | | made by this Act. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
