55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to affidavits concerning cost and necessity of services in
88 civil actions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 18.001, Civil Practice and Remedies
1111 Code, is amended by adding Subsection (a-1) to read as follows:
1212 (a-1) If a claimant offers into evidence a medical bill or
1313 other itemized statement of a medical or health care service and
1414 charge totaling $50,000 or less, an affidavit described by
1515 Subsection (b) is not necessary to support a finding of fact by a
1616 judge or jury that the amount charged was reasonable or that the
1717 service was necessary.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an action that commences on or after the effective date of this
2020 Act.
2121 SECTION 3. This Act takes effect September 1, 2023.
