9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 18.001, Civil Practice and Remedies | |
11 | 11 | Code, is amended by adding Subsection (a-1) to read as follows: | |
12 | 12 | (a-1) If a claimant offers into evidence a medical bill or | |
13 | 13 | other itemized statement of a medical or health care service and | |
14 | 14 | charge totaling $50,000 or less, an affidavit described by | |
15 | 15 | Subsection (b) is not necessary to support a finding of fact by a | |
16 | 16 | judge or jury that the amount charged was reasonable or that the | |
17 | 17 | service was necessary. | |
18 | 18 | SECTION 2. The change in law made by this Act applies only | |
19 | 19 | to an action that commences on or after the effective date of this | |
20 | 20 | Act. | |
21 | 21 | SECTION 3. This Act takes effect September 1, 2023. |
