| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 521.4265(c), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) The department may not: |
|---|
| 13 | 13 | | (1) request a transfer under Subsection (b)(1) if the |
|---|
| 14 | 14 | | balance of the account for the fiscal year is less than three times |
|---|
| 15 | 15 | | the amount expended in the previous fiscal year for the waivers |
|---|
| 16 | 16 | | provided by Sections 521.1015(e), 521.1016, and 521.1811; or |
|---|
| 17 | 17 | | (2) grant an exemption under Section 521.1015, |
|---|
| 18 | 18 | | 521.1016, or 521.1811 if money is not available in the |
|---|
| 19 | 19 | | identification fee exemption account to meet the requirements of |
|---|
| 20 | 20 | | Subsection (b)(2). |

| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
