55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to program accessibility for female inmates of the Texas
88 Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 501.027, Government Code, is amended to
1111 read as follows:
1212 Sec. 501.027. ACCESS TO PROGRAMS BY FEMALE INMATES. (a)
1313 The department shall develop and implement policies that increase
1414 and promote a female inmate's access to programs, including
1515 parenting classes and educational, vocational, substance use
1616 treatment, rehabilitation, life skills training, and prerelease
1717 programs, offered to inmates in the custody of the department,
1818 including programs offered to defendants confined in state jail
1919 felony facilities [including educational, vocational, substance
2020 use treatment, rehabilitation, life skills training, and
2121 prerelease programs]. The department may not reduce or limit a male
2222 inmate's access to a program to meet the requirements of this
2323 section.
2424 (b) The department shall develop and implement policies
2525 that:
2626 (1) require each facility to make the programs
2727 described by Subsection (a) available and accessible to a female
2828 inmate not later than the 45th day after the date the inmate arrives
2929 at the facility;
3030 (2) ensure female inmates have access to program
3131 opportunities, including master's level education courses, that
3232 are equitable to the program opportunities that are provided to
3333 male inmates; and
3434 (3) ensure that vocational programs and any related
3535 certifications are substantively relevant to current workforce
3636 demands and opportunities.
3737 (c) Not later than December 31 of each year, the department
3838 shall:
3939 (1) prepare and submit to the governor, the lieutenant
4040 governor, the speaker of the house of representatives, each
4141 standing committee of the legislature having primary jurisdiction
4242 over the department, and the reentry task force described by
4343 Section 501.098 a written report that includes:
4444 (A) a description of any department policies that
4545 were created, modified, or eliminated during the preceding year to
4646 meet the requirements of this section; and
4747 (B) a list of programs available to female
4848 inmates in the custody of the department during the preceding year;
4949 and
5050 (2) publish the report on the department's Internet
5151 website.
5252 SECTION 2. As soon as practicable after the effective date
5353 of this Act, the Texas Department of Criminal Justice shall develop
5454 and implement the policies necessary to implement the changes in
5555 law made by this Act.
5656 SECTION 3. This Act takes effect September 1, 2023.
