77 relating to the establishment of a higher education plan for human
88 papillomavirus education and prevention.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1111 amended by adding Section 51.9196 to read as follows:
1212 Sec. 51.9196. HUMAN PAPILLOMAVIRUS HIGHER EDUCATION PLAN
1313 AND EDUCATION AND PREVENTION PROGRAM. (a) In this section:
1414 (1) "Coordinating board" means the Texas Higher
1515 Education Coordinating Board.
1616 (2) "Department" means the Department of State Health
1717 Services.
1818 (3) "Institution of higher education" has the meaning
1919 assigned by Section 61.003.
2020 (b) The department, using existing resources and programs
2121 to the extent possible, shall develop a state plan for preventing
2222 and treating human papillomavirus and the health problems caused by
2323 the infection among students enrolled at institutions of higher
2424 education. The plan must include strategies for preventing and
2525 treating human papillomavirus and related health problems in
2626 specific demographic groups that are disproportionately affected
2727 by the infection.
2828 (c) In developing the plan, the department shall seek the
2929 advice of:
3030 (1) the public, including advocates who have been
3131 infected with human papillomavirus;
3232 (2) each state agency that provides services to
3333 persons infected with human papillomavirus or that is assigned
3434 duties related to health problems caused by human papillomavirus,
3535 including the Health and Human Services Commission and the
3636 coordinating board;
3737 (3) any advisory body that addresses issues related to
3838 health problems caused by human papillomavirus;
3939 (4) public advocates concerned with issues related to
4040 health problems caused by human papillomavirus;
4141 (5) providers of services to persons with health
4242 problems caused by human papillomavirus; and
4343 (6) a statewide professional association of
4444 physicians.
4545 (d) The department shall review and modify as necessary the
4646 plan developed under Subsection (b) at least once every five years
4747 and may update the plan biennially.
4848 (e) The coordinating board and the department shall jointly
4949 develop a program to heighten awareness and enhance knowledge and
5050 understanding of human papillomavirus among students enrolled at
5151 institutions of higher education.
5252 (f) The program developed under Subsection (e) must require
5353 the coordinating board and the department to:
5454 (1) conduct health education, public awareness, and
5555 community outreach activities to promote public awareness and
5656 knowledge about the risk factors for, the value of early detection
5757 of, available screening services for, and the options available for
5858 the treatment of health problems caused by human papillomavirus;
5959 and
6060 (2) post on the coordinating board's and department's
6161 respective Internet websites the options available for the
6262 prevention, treatment, and detection of human papillomavirus
6363 infection and the health problems caused by the infection and
6464 information on the risk factors for, method of transmission of, and
6565 value of early detection of the infection.
6666 (g) The coordinating board and the department, using
6767 existing resources, may include in the program developed under
6868 Subsection (e) a study to estimate the current and future impact on
6969 this state of health problems caused by human papillomavirus.
7070 SECTION 2. This Act takes effect September 1, 2023.
