66 AN ACT
77 relating to establishing a minimum wage for school bus drivers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 62, Labor Code, is amended
1010 by adding Section 62.058 to read as follows:
1111 Sec. 62.058. MINIMUM WAGE FOR SCHOOL BUS DRIVERS. (a) In
1212 this section, "school bus driver" means a person employed to
1313 transport students to or from school or a school-sponsored or
1414 school-related activity.
1515 (b) This section applies to:
1616 (1) a public school district with a student enrollment
1717 of 4,500 or more;
1818 (2) an open-enrollment charter school; and
1919 (3) a mass transit authority, commercial
2020 transportation company, or juvenile board that contracts with a
2121 school district described by Subdivision (1) or an open-enrollment
2222 charter school to provide public school transportation.
2323 (c) Notwithstanding Section 62.051 or 62.151 or any other
2424 law, an employer to which this section applies shall pay to each
2525 school bus driver employed by the employer not less than the greater
2626 of:
2727 (1) $15 an hour; or
2828 (2) the federal minimum wage under Section 6, Fair
2929 Labor Standards Act of 1938 (29 U.S.C. Section 206).
3030 SECTION 2. This Act takes effect September 1, 2023.
