6 | 6 | | WHEREAS, 42 U.S.C. Section 265, commonly known as Title 42, |
---|
7 | 7 | | has proven invaluable in managing the crisis at the United |
---|
8 | 8 | | States-Mexico border; and |
---|
9 | 9 | | WHEREAS, Since the invocation of Title 42 by the Trump |
---|
10 | 10 | | administration in March 2020, the U.S. Department of Homeland |
---|
11 | 11 | | Security has used the order more than two million times to rapidly |
---|
12 | 12 | | expel unauthorized migrants; enforcement of the order also serves |
---|
13 | 13 | | as an important deterrent to citizens of other countries |
---|
14 | 14 | | contemplating a dangerous journey to join the massive surge at the |
---|
15 | 15 | | border; and |
---|
16 | 16 | | WHEREAS, Texas border communities have struggled to deal with |
---|
17 | 17 | | the huge influx of migrants, and DHS has relied heavily on Title 42 |
---|
18 | 18 | | to protect these communities from being even more overwhelmed; |
---|
19 | 19 | | during fiscal year 2021, of the more than 1.6 million encounters on |
---|
20 | 20 | | the Southwestern land border, over 60 percent, or around 1 million, |
---|
21 | 21 | | resulted in expulsion under Title 42 authority; and |
---|
22 | 22 | | WHEREAS, Unauthorized migration has reached historic highs, |
---|
23 | 23 | | leading to overcrowding at Border Patrol stations, and officials |
---|
24 | 24 | | have warned that numbers could more than double should Title 42 be |
---|
25 | 25 | | rescinded; recent policy changes at DHS have made the agency even |
---|
26 | 26 | | less able to cope with such a spike if it is forced to fall back |
---|
27 | 27 | | solely on its Title 8 authorities to process and detain migrants; |
---|
28 | 28 | | small border communities, already sorely burdened, lack sufficient |
---|
29 | 29 | | housing, transportation, and health care facilities to absorb an |
---|
30 | 30 | | even greater tide of migrants paroled into their jurisdictions; and |
---|
31 | 31 | | WHEREAS, Rescission of Title 42 during an unprecedented surge |
---|
32 | 32 | | in unauthorized immigration is sure to have a deleterious effect on |
---|
33 | 33 | | border security while degrading quality of life in communities all |
---|
34 | 34 | | along the southwestern border; now, therefore, be it |
---|
35 | 35 | | RESOLVED, That the 88th Legislature of the State of Texas |
---|
36 | 36 | | hereby respectfully urge the president of the United States to keep |
---|
37 | 37 | | Title 42 in place for the duration of the current border crisis; |
---|
38 | 38 | | and, be it further |

39 | 39 | | RESOLVED, That the Texas secretary of state forward an |
---|
40 | 40 | | official copy of this resolution to the president of the United |
---|
41 | 41 | | States of America. |
