55 CONCURRENT RESOLUTION
66 WHEREAS, Across Texas, the number of registered motorcycles
77 is growing at a rapid rate, and numerous motorcyclists have
88 expressed concerns regarding motorcycle profiling by law
99 enforcement officers; and
1010 WHEREAS, Motorcycle profiling is the illegal use of a
1111 person's motorcycle-related apparel or status as a motorcycle
1212 operator as a factor in deciding to stop and question, take
1313 enforcement action toward, arrest, or search a person or vehicle;
1414 and
1515 WHEREAS, Some Texans in motorcycle clubs have been unjustly
1616 stopped and arrested due to being inaccurately identified as gang
1717 members in the TXGANG database, and this has recently prompted
1818 several courts to raise questions about how police use the law
1919 enforcement tool; and
2020 WHEREAS, According to a 2022 U.S. House of Representatives
2121 resolution, reported incidents of motorcycle profiling in the State
2222 of Washington dropped approximately 90 percent since the passing of
2323 a state law to ensure that issues related to motorcycle profiling
2424 are included in law enforcement training; and
2525 WHEREAS, Unlawful motorcycle profiling is a serious issue in
2626 Texas and beyond, and every means of preventing it should be
2727 explored; now, therefore, be it
2828 RESOLVED, That the 88th Legislature of the State of Texas
2929 hereby request that the Lieutenant Governor and the Speaker of the
3030 House of Representatives create a joint interim committee to study
3131 motorcycle operator profiling by law enforcement officers; and, be
3232 it further
3333 RESOLVED, That the study must consider:
3434 (1) the effectiveness of current education and
3535 training requirements for law enforcement officers regarding
3636 motorcycle operator profiling awareness and sensitivity;
3737 (2) potential improvements to education and training
3838 requirements regarding motorcycle operator profiling awareness and
3939 sensitivity that may be implemented by state and local law
4040 enforcement agencies; and
4141 (3) any other methods to decrease motorcycle operator
4242 profiling by law enforcement officers; and, be it further
4343 RESOLVED, That a full report, including findings and
4444 recommendations, be submitted to the 89th Texas Legislature before
4545 it convenes in January 2025.
