44 HOUSE CONCURRENT RESOLUTION
55 WHEREAS, The National Childhood Vaccine Injury Act of 1986
66 has allowed vaccine manufacturers to operate with impunity,
77 shielded from accountability, while American taxpayers ultimately
88 pay the price for injuries caused by their products; and
99 WHEREAS, The NCVIA has shielded vaccine manufacturers from
1010 any and all liability for injuries and deaths resulting from the use
1111 of their products; and
1212 WHEREAS, Enacted on November 14, 1986, the NCVIA has
1313 prevented millions of vaccine-injured individuals from having
1414 their claims heard by a jury of their peers and has denied them
1515 their state and federal constitutional rights of due process; and
1616 WHEREAS, The NCVIA has caused disparities between vaccine
1717 research, other forms of medical research, and the testing of
1818 medical drugs; knowing that they are shielded from claims of
1919 vaccine injury and death, vaccine manufacturers have no incentive
2020 to test their products as rigorously as do manufacturers of other
2121 medical drugs; now, therefore, be it
2222 RESOLVED, That the 88th Legislature of the State of Texas
2323 respectfully urge the United States Congress to repeal the National
2424 Childhood Vaccine Injury Act of 1986; and, be it further
2525 RESOLVED, That the Texas secretary of state forward official
2626 copies of this resolution to the president of the United States, to
2727 the president of the Senate and the speaker of the House of
2828 Representatives of the United States Congress, and to all the
2929 members of the Texas delegation to Congress with the request that
3030 this resolution be officially entered in the Congressional Record
3131 as a memorial to the Congress of the United States of America.
