99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article I, Texas Constitution, is amended by
1111 adding Section 36 to read as follows:
1212 Sec. 36. (a) A person has the right to travel in a vehicle
1313 using human decision-making to operate the vehicle, subject to:
1414 (1) laws or regulations relating to:
1515 (A) who is authorized to operate a vehicle, a
1616 type of vehicle, or a class of vehicles; or
1717 (B) the mental or physical competency required to
1818 operate a vehicle;
1919 (2) laws or regulations that impose or are subject to a
2020 criminal penalty; and
2121 (3) restrictions on the use of a vehicle resulting
2222 from the commission of a criminal offense or other violation of a
2323 law or regulation.
2424 (b) A law or regulation may not be enacted or adopted for the
2525 purpose of abridging the right granted by this section. A law or
2626 regulation enacted or adopted in violation of this subsection is
2727 void and unenforceable.
2828 SECTION 2. This proposed constitutional amendment shall be
2929 submitted to the voters at an election to be held November 7, 2023.
3030 The ballot shall be printed to permit voting for or against the
3131 proposition: "The constitutional amendment recognizing the right
3232 of a person to travel in a vehicle using human decision-making to
3333 operate the vehicle."
